    I am pleased the OP has got this sorted out in the end and Orange held their hands up for the original mistake of not disconnecting the number. I wonder if they would "forget" to connect a number when you were buying the phone so easily?

    There are many adults who would have taken advantage of this situation like the kid did. That doesn't excuse the fact it was wrong. I wonder what proportion of people who find a wallet/mobile/other lost property in the street would actually hand it in. I know I would hand it in*

    Either way these are the Orange T&C's:
    Any SIM Card we supply to you remains our property, but it is your responsibility to keep it safe.
    You must inform us immediately if the SIM Card supplied to you is lost, stolen or damaged. You will remain liable for all Charges incurred until you do so.

    A lucky escape!!

    *I might struggle a bit if I found a huge amount of cash in a briefcase.

    well guys just wanted to thank all you guys for your support and advice

    Bottom line is i shouldnt have sent the sim with the phone, but you have to remember that i thought it was dissconected

    Anyway im glad orange has put their hands up to this, but only after the threat of legal action from myself!

    Glad you have got it sorted out but I dont think that compensation is needed - after all you did send the sim card with the phone - it doesnt matter you thought it was disconnected as you should still have kept it back.

    If Orange are now saying they will take responsibilty for the bill I would just be glad you aren't having to pay it and be happy as it could have been much worse ending. They may offer you a goodwill gesture though like ivanopinion says which would be nice. I just would not push things too far though thats all

    T mobile were really bad in my experience too but reading peoples posts on here there are complaints about them all so its not easy to decide

    good news that the op has got orange to cough up. The thing that made me think in this thread though, was just another nail in my "wanting to become a teacher" coffin. Kid messes around in lessons, gets phone confiscated (phones shoudnt be in schools IMO). Some wazzock steal phone, then teacher has to buy a new one for the boy! What kind of BS is this?

    The kid ran up a £400 bill in 11 days, as if that's normal..........D'oh!

    No wonder you have teachers leaving the proffession when you get kids like this supported by parents like some of the posters on here!

    Totally agree with the above. Can't believe that people would defend what he has done. He knew he shouldn't have been using the sim card that's why he ran up £400 in 11 days, obviously not expecting to repay what he used. He's a 14yr old boy and knows how much it costs to use a mobile phone, did he use this much when he had a PAYG sim in his old phone?

    He used the phone knowing that the sim wasn't a PAYG so he should be made to repay what he has used.

    I had a mobile with O2 that was stolen out of my house 18 months ago. At the time i was ill and didn't know the phone had gone untill i received a letter from O2 telling me of high call usage to the tune of over £300. As far as O2 were concerned because the police wern't informed within 24 hours of the phone going missing it was my problem, it was also my problem that O2 didnt transfer the insurance over to consumer rates from business rates. I ended up having to pay the bill, O2 did nothing as the bill was in my name i was liable. I wish you the best of luck with this but i wouldn't hold out much hope.

    I had an almost identical situation with T-Mobile, I dropped my phone in the street and didn't realise, some !!!!!! picked it up and spent £500 ringing Saudi Arabia. When I realised I'd lost my phone a week later the SIM was cancelled, they sent a replacement, etc, carried on using it as normal. Phone bill arrived month later with £500 bill - !!!!!!?!?! It was only at this point I realised the phone had been used and wasn't lost down a sofa somewhere.
    We refused point blank to pay, T-Mobile said I should've reported it, cancelled SIM within 24 hours, etc. But they eventually cancelled the bill. When we went to the police, the policewoman's reaction was 'well you're not going to pay it, are you?'

    (Our main defence however was that when phoned up to cancel the SIM, we asked if it had been used at all, T-Mobile said no. They later tried to claim that international calls take a few days to show up on their system, but we argued this down as a) there was domestic calls too which they didn't tell us about and b) the guy from NTL told us that was crap - phone companies can see every call you've made straight away)

    In fact, six months later, when the contract ran out, we tried to cancel it and T-Mobile said we'd been 'such good customers' that they knocked line rental down to 99p p/m (750 mins and 50 txts)! They obviously don't keep notes on file!!

    I thought the bit about the teacher buying a phone herself very odd. Normally if a teacher confiscates a child's property they would lock it safely in the school safe. If it was midway through a lesson I would expect them to keep it safe for the duration until they can take it to the school office. If it's stolen from the school then the school is responsible. I think it's worrying that a teacher is buying a second hand phone, with goodness knows what on it and giving it to a child. I know that most secondary schools allow children to bring mobiles to school with them but they must be switched off. I think this is sensible as I know my DD will be walking to secondary school. She also knows the rules, switched off during school hours. If she leaves it on and it's confiscated then I expect it to be taken care of while on their premises.

    Yeah and the fact that it was confiscated was cos it was NOT switched off!

    He broke the rules.............I wouldn't have bothered replacing it....tough it got knicked!

    You say teacher was "VERY ODD" you're telling me........I'd of told the kid tough luck sonny its been knicked!

    Here we go again making excuses for the kid!
