Bought dog and gave back to breeder who won't give money back

I don't see why people are having a go at the OP as they are only asking for advice.
They clearly state that the breeder said that they would not be able to given any money back until they sold the dog on. This had already been agreed before they gave the dog back.
To me it is a mistake that they bought the dog but the breeder had agreed to take it back - they didn't have too. Issue is whether OP has course of action to demand any money back.
I don't know whether you can or not as it is all verbal - as already advised see citizen advice. HTH0 -
I feel that they have changed the origina agreement on returning the dog which was to refund the money once it was resold. Therefore you should as a previous poster stated, reclaim the dog.
Even if you dont keep it, a local dogs home seems sensible or a rescue centre for that particular breed.0 -
Once you paid for the pup it became yours and have no rights to a refund simply because you changed your mind.
You could sue the seller in the small claims procedure in the County Court if you feel the seller renegaded on a further agreement that she would refund if/when she sells the pup - but quite honestly unless an amount of money was agreed at the time then she could offer you a small amount of money as no set amount was agreed. Offering to resell and refund would be classed as a goodwill gesture.
There is no special legislation that relates to purchases of pets, no different than buying anything else.SallyD0 -
It's the dog I feel sorry for.0

Personally, I hope you don't get any money back...it will serve as an expensive lesson to think hard before making such a major commitment to a living creature. We have removed your signature - please contact the forum team if you are not sure why - Forum Team0

I'd get the dog back and then get it put down so the cheeky cow does not have the benefit of selling it again.
What type of dog is it by the way?
My mate collects them and has them stuffed. He's on the lookout for a Westie.0 -

i think perhaps the op should get pup back and rehome it on bechalf of their mother as you have no guarentee of return of original owner
i can understand why people are saying that the digs for life not just for one or two days
try the citizens advice but im not sure what happens regarding refunds of live animals

In my opinion, returning the dog to the breeder was the correct thing to do. I can't believe that people are suggesting that the OP reclaims the dog and either puts it in a rescue shelter or rehomes it. Can you imagine how traumatic the shelter environment is for a tiny puppy? How would that be in anybody's best interests, least of all the poor puppy? Also, I would doubt (with no disrespect intended) that the OP or her family have the knowledge or expertise to adequately and correctly vet a prospective home.
OP, try to get in contact with the breeder directly - do not speak to this 'friend' again. Remind the breeder of the original conversation whereby it was stated that money would be returned once the puppy is sold on. This is very normal practice in such circumstances. I know several very reputable breeders and, in the event of a young puppy being returned to them, they will deduct costs of keeping the dog plus any associated rehoming fees (such as advertising and travel costs where required and any veterinary bills that may have been incurred) and refund the remainder. As far as I am aware, there is no obligation on the breeder to make any refund (unless stated otherwise in a contract - but it sounds like there was no contract in place in this instance) but after such a short space of time it would be reasonable to expect some money back even if not the full amount.0 -
Remember, you are not entitled to a refund simply because you changed your mind any subsequent agreement ie. will refund when pup sold on is another contract and therefore enforceable in the small claim procedure. If you take the seller to court the Registrar will hear both sides of the story and his decision will be binding. There is no guarantees you will win the case. Also, if the friend spoke to you of the refund then there is no point pursuing the seller.SallyD0
