Bought dog and gave back to breeder who won't give money back

Hello,

My mother recently bought a pedigree dog from a breeder for £500 on Tuesday. She had the puppy for two days but unfortunately she realised she had made a mistake and didn't enjoy the experience. My mum suffers from anxiety and panic attacks and suffered a bad attack after getting the dog. She rang the breeder who said she couldn't take the dog back becaue she was going on holiday however her friend (who owns the father of the puppy) would take it back until she gets off holiday. She told my mum that she couldn't afford to give her any money back until she re-sells the dog. On Thursday night we took the dog to the breeders friend, no money was mentioned. My mum has been very emotional and depressed and as a family we decided she needed to make a clean break from the dog, obviously it would've been better for her to keep it for bit longer to see how she goes but she was in no fit state to do this and unfortunately none of our family or friends could take the dog so that's why she'd given it back. She's obviously upset about the money issue as well but I told her to wait a couple of weeks and when she feels a bit better she or one of us could give the breeder a ring to sort out getting the money back.

Today she got a phone call from the breeders mobile (who we thought was on holiday), it wasn't the breeder but her friend who we believe still has the dog. My mum spoke to her and the friend said the breeder doesn't have time to sell the dog and my mum won't be getting any money back. My mum said she felt they were taking advantage of her and it would be reasonable to give her at least half the money back, but the women said no and claimed that in the conversation my mum had with her on Thursday on the phone prior to giving her the dog she told her she wouldn't give her any money and that they were doing her a favour taking it off her.

My mum is very upset and doesn't know what to do. I've told her I would sort it out but I have no idea if there is any legal recourse she can take. I'm sorry for the long winded post, any help regarding this query would be much appreciated.

    Is the breeder a member of the kennel club? If so try contacting them for advice too. Did your mum get a contract of sale with the dog? If so what did it say about returning the dog? Could you get the dog back and try to sell it on yourself?

    Thanks Techno, I will check with my mum. Unfortunately I can't take the dog, work long hours and live in fourth floor flat.

  • There is no way that this dog should remain with the breeder if they will not refund some of the money. They will sell the dog on (if they haven't already).

    Ring them and tell them that if they will not give you some money, then you want the dog back and you will take it to the local dogs home. At least that way it will be guaranteed to go to a good home and the breeder will not be able to resell it.

    I hope that your post makes people think twice before getting a pet.

    why should the breeder give your mother the money back before she resells the pup, who forced your mum to buy the dog? dogs are not like other items brought they are real living creatures, think twice or even three times before buying

    My sympathies lie with the breeder. If you bought anything else for £500 and decided after a couple of days you didn't want it, you'd get short shrift. The breeder may well have used the £500 for their holiday.
    It's your mistake, pure and simple. Dogs aren't sale or return items, you could have advertised it yourselves but once you've bought it it's your responsibility. You can't just dump it back on the breeders' lap and expect them to deal with it.

    You have no legal rights to a refund or to get your dog back. Think carefully before you buy a dog or other pet for someone who can't cope with their own problems let alone deal with a puppy.

    Apologies I originally posted the thread in this section as I was not sure where else to post it. I then noticed the pets section so posted the thread there as well. I'm not sure if as the OP I can delete this thread from this section. If I can please tell me how to do so?

    I am sure that you have no right to get your money back, as once the dog has left the breeders home, they have no idea where or how the puppy has been kept. This is for the reasons of hygiene and health. Also personally I would not give the money back anyway as anyone who buys a puppy should think long and hard about the long term future of the dog.
