Ah, but in similar threads on here when people conplain that the machine didn't give them all (or any) of their money, you normally insist the machines are foolproof.
No I don't.
I tell them not to worry, the machines are balanced weekly, if there is a difference it's easily found and that the machine is usually itself aware of said difference in the first place.

Although there is an argument that not alerting the bank to the situation is immoral, personally I would just spend the money. Although if £60 is a lot of money to you, don't spend it if you can't afford to pay the bank back if they come looking for the money further down the line.0

You have kept and spent money that is not yours due to a fault.
It's theft (technically defrauded the bank) , that's why (and they do) just take it back0 -
It's not theft.
You didn't appropriate property belonging to someone else with intention to permanently deprive.
You had no intent when you received the money - and they put the money in your account, you didn't take it from them. You can't retrospectively apply the mens rea to an actus reus. They need to be simultaneous.
This would be covered by the law of restitution, not fraud or theft.0 -
