I work in HR and I do not share your views.

All you have asked is what you can 'throw at them'.

What they want to hear is remorse and that you will behave better in future. Which, if you actually do regret your actions, is true, but you seem to be unwilling to say it.

Thanks for your input, Most likely HR will be mainly dealing with this so having someone with HR experience offering advice is very useful indeed.

I don't feel sorry for refusing that request as I had genuine reasons for doing so, However I do feel sorry for the way I handled teh whole situation. I know what I Should have done was have a quiet word with teh said manager following teh briefing and explain my concerns to him and kindly ask if he would have minded swapping me over. If he would have refused I should have asked his reasons for why he wouldn't. Both parties handled the situation badly and I for one would just liek to put it behind me and get on with it.

I have made it clear to them in the past I don't like doing teh job and feel more people should be able to do it.My main issue with doing the said job is I'm under constant pressure to ensure the machine don't stop, Toilet breaks well I can forget about them as there is no one to cover me so end up having to hold it in and considering I have a bladder problem that's not a good thing which leaves me feeling very uncomfortable. When I do get chance to have a break I often have to have a shorter break because as there is no one that knows how to do the job they just mess it up.

What I mean is by I need something to throw at them is my company is not a very nice company, it is full of !!! lickers and the company will try and screw anyone over at any given opportunity, We have recently taken a pay cut and then immediately after they went out and brought four new double Decker lorries and 200k a piece and invested heavily in some new technology which just makes the job slower. I don't like having to stoop to there level but if they are going to do so then I have no choice really but to try and play them at there own game.

    So.

Leave the coffee thing out of it totally. It's not what you are being called in for. It will muddy the waters and acknowledging you turned up on site intoxicated to any degree will not help.

Explain why you don't like that task (bladder/ breaks only)

Suggest an alternative eg happy to help train other people up so you can do maybe part of a shift each on it/ there is more cover.

Apologise for you attitude, perhaps stating both of you were confrontational and it didn't help matters, but you know you were wrong.

How they spend their capital investment is not your business and leave the wage cut arguement out of it; that's dead and gone. Stay totally focussed on the subject of the disciplinary.

Yup, what Emmzi said....with bells on.

I don't think you are going to find a loophole, and having a go about everything else will only make them want to get rid of you faster.

you cant stop for a toilet break but you go for a fag break when you feel like it. cant you use the toilet when you stop for a fag?

theres no point adapting your post to make it sound like you were in the right.

the other workers had "asked" not to do the job where you flatly refused to do it. there is a big difference between the 2

OP I would remove ASAP your references on this thread about the company you work for being corrupt. If your employer finds this thread they will rightly sack you.

i think if you can have the maturity to admit this to the company - possibly in writing, it could go a long way. often both sides would like a way to back track out of a situation but if you display a bad attitude this will make it much more unlikely for your employers to sympathise. i'd eat humble pie and avoid the temptation to !!!!! about the situation with any colleagues (even those you might usually confide in). go down the 'having a bad day route', many apologies, i was out of order, it absolutely won't happen again. and if your manager gives you the shoddy jobs again do them with good grace.

this is not a good time to be out of work.

the other point is that if you ask not to do something and your employer still says you should do it - then you should do it (unless it is breaking the law or something). the fag break / toilet thing sounds like an excuse not to do a task you're not keen on.

you need to get your story straight and beg for your job.
If you dont your gonna be up the jobcenter and they will sanction your benefits because you were sacked.
