Xbox 360 - Sales of Goods Act Question

Hi,
I have a preowned Xbox 360 (Bought in December 2008 from Gamestation), which has recently died on me. Gamestation told me they had tested it and guaranteed that it was in working order.
I am told that Preowned consoles are covered for a year under the sales of goods act, which is also backed up by the second post at the following thread: showthread.html?t=1703409. Could somebody here please confirm this for me.

what your mentioning sounds like a separate warranty?Back by no demand whatsoever.0 -

It's more the fact that it's a preowned console than anything else. I was going to go into gamestation tomorrow, but they'll probably try to fob me off with something like contact microsoft/it's not covered by sales of good act/it's out of warranty etc.
Does anyone know the specific part of the sales of goods act that this would be covered by?

well if you havnt been given a warranty on it then you are covered by section 14 of the sale of goods act in regards to "e)durability" and "satisfactory quality"
if they say how microsoft have accepted liability ignore and say that this is only for in warranty xbox RROD faults(not sure what fault you have but either way), so in your case it is the retailer who is responsible, if the spotty teenager looks confused ask for someone who knows about statutory rights.
also if you bought it on credit card you could claim against them under section 75 of the consumer credit act as they are "jointly and severably liable" for faulty goodsBack by no demand whatsoever.0 -
I had a faulty pre-owned XBOX 360 through Gamestation. I returned it with the original receipt and they swapped it straight away. I was told that all pre-owned consoles were covered for 12 months.LBM : March 2008

How long would you expect an xbox 360 to last mine has died after 18 months i alreday had it repaired for 3 lights within the year but now have been informed this is a different problem i.e. 2 lights and need to pay if i want it repaired. Is there any point am i a fool to have expected it to last any longer. i would never have bought it if i thought it would break down so soon.0

Do you think this will help me. I bougtht an x-box 360 in dec 07 from argos and it broke with 3 lights just under a year, Argos sent it through microsoft for us (we were given 3 year warranty)and it worked for a few months but the 2 lights became more and more frequent despite ventilation etc. Not being used for few months as red lights come on within few minues. Microsoft informed me that new fault is overheating and not covered by the warranty which is for the motherboard. Is it reasonable to have expected this x-box to have lasted longer, who should i complain too. Angie0

Absolute rubbish !
You are covered for 6 months by SOGA - you have rights to claim damages for up to 6 years , but YOU then have to prove the item was faulty when you bought it.

Yes you should be covered by a 12 month warrenty. Most shops try and shirk out replacing xbox's because they are known to have cheap components that over heat and break.
If you have the 3 red light ring of death my suggestion would be to contact xbox (see there website) and get them to fix it. All xbox's have a 3 year warrenty against red ring of death. I've just had mine fixed .. took 2 weeks. Microsoft pay for postage and is picked up by UPS.
You might encounter a problem if the xbox is older than 3 years though or has been registered before ... only way to find out it phone Xbox.0
