Ask did they take a sample of the poo, which should have dna, then get it tested against your dog. Surely its up to them to prove that its your dogs poo.
If is definately isnt then they will burden the cost of the test.
Alternatively you could ask for a lineup and ask the officer to pick out which dog he saw in the act of the offence.

My mums dog didn't poo, but having read these threads sounds like she will have to pay it! So annoyed though!0

She shouldn't pay if she's innocent- remember they have to prove their case to the criminal standard of proof, and your mother would be able to cross-examine the witnesses to highlight any inconsistencies in their statements.
If your mother claims the poo was left by another dog then it is up to them to prove otherwise.
In many cases FPNs that are not accepted never actually go any further because the CPS doesn't have a realistic prospect of getting a conviction.
As for costs, if your mother is acquited then she will be able to reclaim some costs, at the judge's discretion.0 -
I'd still like to know if they gave her the ticket straight after the "event" or at some time later. If later how could they prove beyond doubt her pet was guilty, unless they now have little cameras like the CEO's do.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

They don't have the power of arrest, though it is an offence not to give your name to 'authorised officers' who read you the "It is an offence, when questioned not to say something you later rely on in court......" etc.
Don't you mean "You do not have to say anything unless you wish to do so, but it may harm your defence if you fail to mention when questioned something that you later rely on in court"
Haven't watched the bill for a while so I might have forgotten the wording. But my advice to any council busy body would be to go forth and multiple unless they had a copper there. If they don't have your name they can't fine you.0 -
