ebay seller refunded my money instead of sending me the item

hi everyone... i just bought a brand new digital frame from a seller (was buy it now) and paid him instantly and requested him to send it by this friday as i am flying abroad on that date. He said it is fine but after couple of days said that the box has been opened before and bit soiled and said that he was let down by his supplier and gave me choice of buying a new better frame for extra money or refund my money. and few days back he refunded my money.
When i emailed him saying that i would be giving him a negative feedback.. he emailed me the following,
t was un-intentional i have been let down by my supplier my description was accurate, the items i have been sent were wrong, i followed ebay protocol to refund asap and explain, under distance selling rules i have the right to withdraw my sale within 7 days with plausable explanation, if you give me negative feedback that would be very in-considerate and will portray a bad image of yourself, i have done nothing wrong. i will have no choice but to take it up with ebay and withdraw the feedback as i have proof of refund and explanation,
so my question is am i suppose to give him negative feedback or just leave the matter as it is as he has already refunded my money.
any comment wud really be appreciated.

If you left negative feedback ebay would not withdraw it as no even if he has an explanation ebay wont really care. He's just trying it on. If you are unhappy wth his explanation you could always file an INR dispute and report as a NPS.
As it was a BIN it does not sound as he sold it to cheaply and wated to sell it for more so is withdrawing from the sale. If it had been me I would have offered you the more expensive frame at the original price.
It is up to you what feedback you give are you happy with his explanation etc. If it were me I would probably give a neutral at most. But lifes too short to worry too much so I would just make a decision quickly and move on. Personally I just wouldnt give him any feedback at all.0 -

How do you feel about the transaction. It seems to have left you with a negative image of the seller so leave feedback accordingly.
There are very few reasons ebay will withdraw feedback and not having an item available to send after it has sold is not one of them. As long as you leave feedback in line with ebay rules (i.e. about the transaction, no abuse, no personal details etc.) I can't see any request to have it removed being honoured."Now to trolling as a concept. .... That's probably a good decision - it's one I often decide upon when I've got a full refund without any hassle.

to be honest, i don't see why you would leave a neg?
you have been refunded with no problems (that i can see) over something the seller had no control of..if you had gone to comet (example) & they didn't have the item in stock would you complian to cutomer services?
if it were me i'd either be leaving a postive saying thanks for prompt refund over misunderstanding or none at all..just my opinion though!0 -
with the new system - people are more willing to leave negatives etc - he gave you a full refund quickly or offered a replacement at an extra cost so seems he did his best to resolve teh situation0

Ye i do understand that but isnt it sellers responsibility to check the item before they list it on ebay.its not just about refund is it. its about the contract that exis between seller and buyer and their obligation to eachother.0 -

He realy should have offered a replacement at NO extra cost. Ebay requires you to have the items in stock or available to ship within 7 days. If not you shouldnt be listing them.
So he didnt realy do his best to resolve the situation. I think not leaving feedback is the best outcome but if he had got a neg or a neutral it would have been due to his poor handling of the situation and well deserved0 -
I had a similar issue with some lights that I purchased from ebay. Seller claimed the item was damaged in transit and returne dback to the seller by DHL. Didn't believe the seller as he has others on sale of the same item. Left a neg which was the seller should have got.
I was under the impression that a seller should not list an item on ebay unless they have the physical goods or service to hand to send out immediately.0
