Returning reconditioned phone

Ordered a refurbished phone from O2 online for mothers day for my mother and it never turned up, didn't bother about it because just thought the order would have failed so got her a different one from a shop.

Anyway credit card bill turns up and they have charged me for it, I ring them up and ask whats going on and they say it was sent out weeks ago with DHL.

Ring DHL who say "yeah we've got a parcel waiting here for you" !!!!!!, where was the DELIVERY!!!

Anyway, like I said, we already got a different phone now so no longer need this one, am I still ok to return the phone even if it is a refurbished handset!?!?

    What do you mean return it? I'd ask for a refund on the grounds it was never delivered; let O2 discuss the non-delivery with DHL, not with you.

    Tried that already - got stonewalled by some idiot O2 CS'er with "sorry, but there's nothing more we can do, DHL have it"

    At the end of the day if they are going to refuse to refund, I can't make them unless I get the phone delivered and then return it for a refund.

    God knows when I can get it delivered though, everytime I ring DHL "their system is down" - for 3 days?!?!?!

    You have 7 days to return it from the date of receipt, under the Distance Selling Regulations.
