    Sometimes the only way to resolve the issue is the court process.
    These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

    I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!

    I can see where you're coming from and given the agent's attitude (he actually left the courtroom halfway through the judgment :rolleyes:) I was fully expecting having to resort to the bailiffs.

    However, we actually received his payment in full - albeit not before a few days after the deadline and accompanied by a little essay on how he felt about us and about the British justice system ...

  • He argued that his computer system would not allow making a booking for a flight that departed within 48 hours and that I had circumvented that by using a screenscraper (that's where the "coming through the back door" bit came from). Well, I didn't do that on purpose just so as to give us a headache at the airport, did I? The judge put him straight on this, however, and told him that it was up to him to sort out his computer system.

    The agent also argued that no contract existed since they had not debited my card. However, the judge deemed their e-mail confirmation together with the absence of any notification of problems with the booking to be sufficient to constitute a contract.

  • As I had a feeling we might end up in court, I did not name him in this thread. However, I actually did it at the time over on the travel board: http://forums.moneysavingexpert.com/showthread.html?t=1813477.

    Not without him noticing btw, as he promised me mail from his lawyers when we met in court before the hearing. Hasn't arrived yet though ... :rolleyes:
