My daughters hours is a signed contract which is 33 hours, they have now decided to reduce her hours to 24 hours and told her that she wont get her holiday pay next month for the 33 hours, which she needs, she has not signed a new contract for the 24 hours, she is still contracted to 33 hours, so can they do this?? She just got back form holiday to be told this via grapevine so went and saw her manager and was told this.

does the contract say you will work 33 hours .. or not because if it doesnt then they do not have to give her 33 hours holdiay pay

Yes she can do as much overtime as she wants, but what i want to know is, can they cut her holiday pay down for next month to 24 hours even though she is still on a 33 hour contract?

As far as I am aware her contract can be reduced but only after a consultation period of at least a month, without this taking place she should still be on 33hours pay / holiday0

She just told about it when she got back to work on Thurs, heard it as a rumour, had word with her manager and he says yes her hours will be getting reduced, and she is still waiting to hear about her new contract, so i told her not to sign anything until she makes sure she gets her holiday pay for the 33 hours, also told her to find out if asda has a union.

How old is she? Is she over 18? Is it a large company or small? How many staff are affected? How long has she been working there?
They need to give the letter to her in writing, stating the reason why the reduced hours, and giving at least 28 days notice of the change from the date of the letter.
If holiday was agreed prior to contract change (which hasn't happened, as she's not been notified in writing) and has taken place at the agreed time and rate, then that shouldn't change.
Has she spoken to ACAS?
Is she the only one affected, or is this all staff?
Does she belong to a union?0 -

She was 18 june just past there, she is only one affected, she has been with asda for 2 years now, she was on 33 hours for the last 2 or 4 months, and she came back from Spain Tues there to head through grapevine that her hours will be cut, she got hld of manager who confirmed this, she has not had a letter, she is waiting on manager giving her a shout to go in office with him and the accountant.
She sais she is sure there is a union but has no one ot really ask, as its a revently new shift she does not know anyone on it, as i say this is a recently new shift, and now she is getting hourse reduced again, no letter, no notice just been told and also been told she wont get holiday pay based on the 33 hours, when i called him and said this is not right, he told me he will have to clarify this with acccountant.
The holiday was booked well in advance since last year, and what is ACAS?0
