Virgin Media - are they breaking the contract?

I signed up with Virgin Media for a 12 month contract for a monthly phone line rental of £11 per month combined with broadband at £4.50 a month. Having reviewed my bills on line all of them are more than the £15.50 they said they were going to charge (excluding calls).

When I phoned them to query this they said the broadband charge had gone up in price. But are they in breach of contract? I thought I'd signed up for a 12 month contract at a fixed price......:mad:

    albeit well hidden it dose state in the t&c's that they can change the price as they see fit an upon taking a contract out you agree they can do this

    Not if like this deal it was offered for 12 months.

    H Changing these agreements

    3, Virgin Media Ltd and/or Virgin Media Entertainment and/ or Virgin Media Payments may change their respective charges at any time. Any such changes will be published in the monthly charges made by us and/or Virgin Media Entertainment and/or Virgin Media Payments on the Virgin Media Ltd website (or the Virgin Media Entertainment website with regard to premium television services) and we, Virgin Media Entertainment and Virgin Media Payments will do our best to give you notice of the change at least one month before the change takes effect. Any changes to usage charges and tariffs will be published on the Virgin Media Ltd website or the Virgin Media Entertainment website (as applicable) and will be reflected on your next bill.

    If they put prices you can however leave.

    If:
    1. Virgin Media Ltd, Virgin Media Entertainment and/or Virgin Media Payments increase their respective charges under these agreements;
    2. Virgin Media Ltd and/or Virgin Media Entertainment make significant changes to the services so the services you are entitled to receive in return for the charges you pay are significantly altered or reduced; or
    3. Virgin Media Ltd, Virgin Media Entertainment and/or Virgin Media Payments make significant changes to the terms and conditions of these agreements (including the other legal stuff),
    you may cancel those services affected without penalty by giving Virgin Media Ltd and/or Virgin Media Entertainment (as applicable) at least 30 days' notice in writing. If you cancel any services in these circumstances, the increased charges will not apply to those services during the 30-day notice period and paragraph J3 will not apply if you cancel before the end of the minimum period. If you do not give such notice of cancellation within 30 days of any increase in charges or changes to the services or this agreement being notified to you or, if later, receipt of your first bill following such increase in charges, Virgin Media, Virgin Media Entertainment (if applicable) and Virgin Media Payments will assume that you have accepted the increase in charges and the changes to the services and these agreements and you will no longer be able to cancel your services under this paragraph.

    The battle to attract customers from Sky (and other Internet Service Providers) continues at Virgin Media with the introduction of a broadband for £4.50 a month offer. This is a 12 month deal provided that you switch your phone line rental to Virgin. This costs £11 a month (the same as if you were with BT) so you can get cheap broadband just for effectively switching to Virgin.
    Here are the latest offers from Virgin Media:
    £4.50 Broadband. - M broadband is £4.50 for 12 months when taken with a phone line (£11 monthly). L and XL broadband are also reduced when taken with phone - £11.50 & £22.50 respectively

    The above deal (taken from the link in the thread above) is exactly what I thought I was signing up too (and I have a screen capture copy of their original advert at the time - when I signed up to this). It stated this was a 12 month deal at £4.50 for the broadband when coupled with the phone line at £11 per month.

    It still sounds to me like they are in breach of contract!

    Yes they are. You have signed up for a fixed price for 12 months. The clause in their terms and conditions is unenforcible as it is one sided. So call retentions and inform them that they have varied the terms of your agreement and ask for a credit back.

    Only this morning I challenenged the fact that they had been taking £1.25 + VAT as a paper billing charge, and I was refunded the last three months of charges and credited for all future charges.

    Why, because it comes under the same banner as bank charges, ie unfair changes to contracts where you are given no opportunity to cancel the contract. Go ask for your money back.
