I would also like to say that there a lot of people who are very quick to judge here!. I come from very poor background and would never call myself rich but I would like to better myself and try to give a better future for our family. I don't think there is anything wrong in that. At the moment investment in brick in mortar is better than putting your money in a bank account and this is what we were trying to do.

Terribly sorry to bring this thread up but I've found myself in a similar situation to the OP and I'm feeling pretty much shat on at the moment.
Basically a chain of 3 has exchanged contracts, I'm a FTB buying a house from an elderly couple. They are buying off another couple, that couple are moving into an empty house.
The second non elderly couple have found out inbetween exchange and completion (29th of may) that the wife has cancer and has been given 2 months to live. They're refusing to move.
My solicitor advised against forcing them to move out as a judge would likely side with sympathy and the ill wife. I've since waited the 10 days (finished yesterday) and rescinded the contract. What do I do next? Am I liable for any compensation beyond my losses?
Would be great full if the OP could help me out here as I'm basically in the same boat as they were I believe

Sorry if it isn't clear but so far my solicitor has basically said ill get my deposit etc. back + my costs and that's that.
I'm wondering if I'm able to claim any compensation for the stress of having to get ready to move (my sons school, my other half changed jobs etc.) or something similar?
At the moment my solicitor seems to think ill struggle to get even silly things like a charge to send a large amount of money over. She is looking into other cases though, even though this rarely happens. That's why I was Hoping for a bit of experience from the OP.0 -

Have the couple concerned provided medical proof of the diagnosis (GP certificate? I realise that this is a difficult question to ask but someone could possibly invent such an excuse simply because he/she thinks that noone would dare to challenge it and so they would get away with it and not be financially penalised.0 -
I have no reason to disbelieve them, the lady as been in and out of hospital for weeks (I realise this could also be lies) so cancer would be a reasonable excuse.
Either way how does that change anything? Fact is the contract has been rescinded and all I want now is my money back, and possibly some compensation beyond my losses to put towards another house0 -

No it doesn't. OP told us simply what his solicitor had said about rescinding the contract. OP was asking what he did next, and whether he could get compensation.

You are entitled to claim for all consequential losses but I very much doubt you will be able to claim for stress - not very quantifiable or necessarily foreseeable.
Your solicitor is looking into this, and has the full facts, so wait for them to answer rather than second guessing?0
