What happens after DLA appeal tribunal?

    Just phoned DWP, they got the forms and money has been sent out so should be with us in a few days, as should a letter awarding wife DLA I guess.

  • hi wonder whats the point in having a tribuiral if like myself you win then the dwp just seem to mess about after they have requested a report from the tribuiral judge is this standard or are they a law unto them selfs what a waste of money they need to back pay me is this why thay are messing me about helpppppppppppppppppppppppp

    If the DWP think there may have been an error in law they can request a statement of reasons and can request a further appeal. If your appeal had failed you could have done the same thing.

    It not make any difference if they have seen you or not as they will decide whether to appeal based on the Statement Of Reasons.
  • i understand what your saying but the tribunral judge/spokes oerson knows the law so there points of law must be right to come to there decsion

    When a tribunal makes a decision, both parties have the right to appeal to a higher court if they believe the tribunal made a mistake by not applying the law correctly.

    That is how the legal system works.

    The DWP are obliged to consider the tribunal's decision to see if they are happy that there have been no errors of law. 9 times out of 10, they accept the tribunal's decision and make the payment. But they have a duty to the taxpayers to ensure that they have done their job properly first.

    I know it is stressful, and you have done well to get this far. You just need to be patient for a little while longer. You should hear from them fairly soon.

    LazyDaisy has pretty well covered it and given a good answer but just to confirm that in the majority of cases the tribunal do get it right but on the odd occasion there are errors.
