Mobile Phone not working

Hi guys.
(I know, I know. Drama seems to attract to me, right?)
A few weeks ago my mobile phone - an LG Viewty - stopped working. It took a photo, and while processes it it died. It comes up wiht a yellow screen and "Refreshing" written on it and wouldn't do anything else. I tried all the standard stuff, turning on and off, taking the battery out, nothing.
I took it into o2 and was told it could be fixed under warrenty. Although I don't seem to be able to find an exact date of purchase (My contract was just a continued contract on the same plan) I know it was in June sometime, and I handed the phone over in June.
After a full week o2 ring to tell me that it can't be repaired under warrenty because the waarenty has expired. At the time I didn't think things through and just told them to transfer the repair onto the insurance I had taken out against the phone. They agreed to that but are waiting on me paying the excess on the policy before the repairs take place.
They are still waiting for this so I guess the phone hasn't been repaired yet. Everything is, as far as I'm aware, pending my excess payment.
However, I've now come to wonder if there's any legislation that would support me getting it repaired for free? Isn't there something that supports the consumer for 6 years?

Any sold has to be 'fit for purpose' and even if the warranty is 12 months if it goes wrong just after you have a case.
The problem here maybe that you've agreed to a changeable repair, it may be very hard to rescind that after the fact ?0
