Seller hasnt used photo of actual item..what next?

Hi,
I've won an item from ebay and with a bit more investigation I have found the exact same photograph on another site (autotrader, major give away being that autotrader use the copyright on the corner) I cant see that the listing on AT would be stolen from ebay. The items are listed slightly differently and are in differnt locations (different ends of the country)

I asked the seller this prior to auction ending but didnt get a reply, but foolishly (perhaps) bidded and won anyway. I asked again if the item was indeed the one in the photo when asking for contact details, no reply to the query but did get contact number.

If the item is not the one in the photo and the seller did not state this in the listing where do I stand? Is it false advertising? Am I still under obligation to carry out the transaction even if the item is not the one pictured? Or have I been a prat?

Any replies will greatly help.

    I think thats what I will have to do just wait and see, but if I get there (this is a 200mile round trip) and its not as advertised (as in doesnt look anything like the pic) do I have to complete the sale?
    Sounds like I'm trying to get out of the transaction, I'm not, I just wanted to know where I'd stand if the item isnt what was pictured. I'm going to be gutted if its not.

    I can't see why you have to buy it if they gave the wrong pic - not as advertised!!

    assuming it is not a car and the item is new why do you need the actual photo of the item. If I am selling new stuff I normally use a stock photo.

    You are being a little cryptic in your question for any qualified advice.

    No you don't have to complete the sale if it's not as advertised. Although if I were you, I probably wouldn't even bother to go see it, it's probably a scrapper....

    Did you need a quailification to become part of the "picky police" or just like to add nothing to this thread? That is rather insulting to point my simple mistake out.



    Thank you to all those giving helpful and reassuring advice, I was slightly worried over it. Hopefully everything will be ok.
