Hi,
This is my first post, I hope it's in the right place?
On the 25/6/09 I bought a camera off Ebay from a company that runs an Ebay shop. I used my business Maestro debit card to pay for the camera. While I was on the phone giving the payment details, the company offered me the chance to buy a lens that I was also after. I accepted the offer and paid for the lens at the same time.
The cost of the camera was £4219.98 inc. p&p. The lens was another £999.99.
I recieved the camera without any problem, but I have still not recieved the lens. They keep fobbing me off by saying that it is due in any day now. This has gone on for six weeks now.
Today, they have told me that they have put a cheque in the post to refund me the £999.99. I can only hope that it arrives and clears ok.
I have read that I could claim for consequential damages in the small claims court because I have lost some business through not having the lens and also that I am now going to have to buy the lens somewhere else for an extra £350.
Is this correct? Are there any websites that will explain this and where I can download template letters?
I have already surfed the net, but cannot find anything that relates directly to my problem, they speak in much more general terms which I am finding difficult to understand.
Thanks for any help you can offer,
Sussex

You can sue in small claims court for them breaking the contract if it can be proven and they havent claimed that it would take that length of time, normally its 28 days and for 'loss of a bargain' as you cant buy it cheaper else where so you sue for teh difference in buying else where0

A debit card as well? You had no protection whatsoever if it had gone wrong! personally I wouldn't be worrying about suing for anything I would be more worried about the £999 I was still waiting for.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
