Changing Network - losing credit

At the moment my Network is with Fresh, as from 01 July they stopped international roaming which is a problem for me. My tafiff is on a one rate direct debit which is basically similar to pay as you go but automatically tops up each month by DD.

I have credit of £35 which I have been told I will lose if I change to another Network. I hve queried this with Fresh as I consider I am no longer getting the service I originally required and therefore feel they should refund this to me as they are in the wrong.

Does anyone have any thoughts on this or know if what Fresh is doing is legal? Any advice would be gratefully received.

    Many networks unfortunately have terms and conditions relating to top-up's which state that they are non-refundable. I have skim- read Fresh's and there is a line under sect. 9.5 that says:

    These credits cannot be redeemed for cash and any unused credits are non-refundable upon disconnection of your service or termination of this Agreement.

    So it sucks but you might have to live with it as you effectively agreed to it... sorry :-(
