Barclays credit card ppi

Having noticed my husband was paying £80 per month PPI on his credit card payments that he was unaware of as he pays by DD, he rang them to find out when this was taken out, they said 2001 but we have since written asking for a copy of the application form. Despite sending all sorts of other information they
have not been able to provide any documentation in support of the PPI. They have now sent us a form to complete which we have just sent back. Has anyone else had a similar problem? Any ideas if we have a case?

Yes, just asking details of complaint, how did he purchase the policy, was he informed of 30 day cancellation policy, and asking details of his employment etc. I just said no idea how the policy was purchased as didn't know it existed (and Barclays have been unable to provide any evidence of when and how it was purchased) also said that he was self employed at the time they are saying it started so would not have knowingly agreed to it anyway.
Any advice is appreciated, thank you.0 -

Is the account still running at all?
Anyway, with this form to complete, not everyone completes them, but you can if you want to, although because the 6 years have passed, the chances are they will possibly require the information, but just write to the best of your knowledge, and of course you can write a letter to go along with it as well if you want to.
There is a link here below with templates and guidelines of reclaiming, the you can use the template if you want to or just as a guide, they have 8 weeks to respond in full.

Keep at them, if they do not resolve this in your favour, you are entitled to take this to the financial ombudsman service (FOS).

The reason why I ask if the account is still active, then your hubby can request a Subject Access Request (SAR), if you live in England or Wales, they should provide everything on the SAR going back as far as 6 years, Scotland is 5 years, even though they state they cannot provide the agreement, sometimes it just appears with these SAR requests, but if still active or if the account was settled the years as stated above, there should be no problem in receiving all that documentation.
There is charge of £10 postal order or cheque payment for this, they have 40 days to comply, again post by recorded delivery, the link is here for the SAR template.;)

Thanks Di, the credit card is still current with an outstanding balance but we cancelled the PPI in April as soon as I noticed it, I can't believe £80 of a monthly minimum payment of about £220 was going to PPI instead of coming off the outstanding balance. It is such a high percentage as an insurance policy. he would never had knowingly agreed to it if he had been given the option and the costs, I am am positive.

Hi Pinny, your hubby has a good case here, so keep at them.;)
Its very expensive isn't it? not to forget the interest as well.
As its still current they can then as I mentioned in the post I just posted above, the documentation going back as far as 5 or 6 years depending where you live, so give it a go.;)
You will be fine.
Also just to say, if you do write to reclaim as well, if they respond, they may try to fob you off by saying "you must have been aware, because you signed blah blah" but to not worry, this is just standard, you then write back to them and ask them to reconsider, until they confirm the details of the FOS.
Hopefully though, they will resolve in your hubbys favour and you won't have to go to the FOS, who are also a free service.;)The one and only "Dizzy Di"0 -

Well any problems, when you request this by SAR, this gives them 40 days to send the info as you pay for this they must provide everything they possibly can, when you receive these, check through the documentation and if you feel anything is missing, then write back and give them say 7-10 days to provide the rest of it, or if they are unable to then write back with a full explanation of why they cannot provide the information, also make them aware you will be in touch with the ICO, this should shift them, any problems then contact the Information Commissioners Office (ICO), who should be able to help and contact them on your behalf.

You can post back first if you want to, just to let us know what the outcome is so far of the SAR and we can help you step by step from there, to make things a little easier for you.
You would be best to get a reclaim letter done first and complete what you can on the questionaire.

I sent a claim to Barclaycard for misselling and was also sent the questionnaire which I duly completed and returned. Within three weeks I had a positive response from them and I have yesterday received the refund to my bank account even though my account is still open. My refund was very small in value (going back to 2003 and cancelled in 2006) so I am not sure if that's why it all went so smoothly and with no quibbling. They just said that they can't prove how the policy was sold therefore they will refund me plus interest plus 8% statutory interest which came in just under n£400.
I hope that your complaint is resolved speediily and you don't wait too long for a refund. If you have any problems Di is always a good source of information and help. Good luck.0 -
