Requested photo evidence, they claim no blue badge can be seen on the dash.

"Photo evidence" is virtually meaningless BTW. It is the bottom of the evidential food chain and there are a whole screed of things that need to be right, properly in place and demonstrated before it would even be admitted as any sort of evidence.

In fact, in most circumstances it is little more than another empty threat to scare the victim with.

As well as getting the text of the full ticket checked, you should be considering requesting copies of the apropriate Traffic Regulation Orders (TROs) and seeing that they are properly up to date and in force. :)

OP, why don't you just accept that the authorities were right and pay the penalty? You know, just as you are suggesting someone does on another thead, because they've received a NIP.

Have now consulted solicitors and are preparing documents should the case go to court

Solicitors know nothing about CPE. They have no interest because there is no money in it. You cannot recoup legal fees.

Errrrrm, what 'Court' ?? It is nothing to do with a Court?

If my ticket isn't upheld, I have found a solicitor that is willing to take this matter on, they have advised me on when to instruct them, maybe not around you there may not be one but I happen to have a very good solicitor who deals with most things.

My case will be submitted for county court review in event they don't cancel the ticket.
My costs will be claimed back via the council should at the end, the ticket be upheld after a court appeal, if not then its a no win no fee case

    Phhhhrrrrrwwwww!

Like I said, if your solicitor knows anything you would not be making such statements. Did any of that come from him/her?

Not near me? LOL. Nowhere apart from those involved with the relevant picture. Other than those --- a solicitor who works for nothing LOL, LOL, LOL. You are having a laugh.

A County Court will not even begin to consider hearing such a case. They are not allowed to since the mechanism for appeal is already set down in statute.

Even if you used a 'Small Claim' after the event of a succesful appeal, to recoup costs, then the Council would automatically object to a case being entertained at a County Court since it is not the appropriate authority.

--and you still talk about a 'Court appeal' re the PCN. Like I said, what Court?

If your 'solicitor' hasn't told you any of this then that just about sums it up!! LOL.

Hey, here's an idea. Give your 'solicitor' a ring and ask them what legislation they will be referring to exactly in acting on your behalf????

Point is. Many of us know the system is unfair ---- but it is playable. Win lots!
Try bringing your own ball onto the pitch and it will be swiftly kicked out of the stadium.

Pleeeeeeze do let us know how you get on: I could do with a laugh.
