PCN Issued

Hi guys


Last month I went into town as normal and parked on double yellow lines as I always do with a valid blue badge displayed, there are alwasy cars infront on me and behind me, this day was no different.
I checked with the Police about parking there a few months ago when a Police officer issued a road traffic offence ticket with no points to my car, they instantly revoked the ticket confirming with a blue badge you are allowed to park there.
Now last month a parking guy placed a ticket on the car stating that it was parked on double yellow lines, by saying this he claims no blue park card was displayed when in fact it was.
I have appealed the ticket and currently awaiting the council's outcome, I contacted them last week as its been 5 weeks now and I was told due to my appeal the matter has been passed to an investigating officer as I have stated I had a blue badge on display, they have seen this with regards this appeal to confirm such.
What are my likely outcomes?
I refuse to pay it as I was parked correctly and prepared to take this to court if need be!

    Show us the ticket (all of it) and someone will advise you whether or not the ticket itself is right.

    On the PCN it states the following:

    The traffic management act 2004. s.78 civil enforcement of parking contraventions (England) general regulations 2007. civil enforecement of parking contraventations (England) representations and appeals regulations 2007.

    Make: Ford


    Time first observed from 12.57
    to 13.02

    A penalty charge of £70 is now payable and must be paid not later than the last day of the period of 28 days beginning with the date on which this PCN was issued.

    The penalty charge will be reduced by a discount of 50% to £35.00 if it is not paid no later than the last day of the period of 14 days beginning with the date on which this PCN was served.



    Any advice please, I have parked there since, ticket officers have passed ad nothing, loads of cars park there, nothing, I refuse to pay whne I know dam well I am in the right, not the council!:mad:

    On the back is where to write to in order to appeal etc
    with address details, email and telephone

    Although the back seems to be full of jargon and bumph its often this which will get you off. Thats why Sarah asked for it, it may not look important to you but it is.

    So why would the parking attendant say there was no badge displayed when you say it was.:confused:

    You do realise they take a photo dont you.

    Ask to see the photo of your car with the blue badge not on display.

    Parking services were contacted today.

    Requested photo evidence, they claim no blue badge can be seen on the dash.
    Currently under investigation by council officers, have been told the blue badge will go into account on making the choice to cancel the PCN or not.

    Been told to expect a wait of another 3-4 weeks for outcome.

    Have now consulted solicitors and are preparing documents should the case go to court
