new job and already displaced!

Hi, I started a new job less than 6 months ago, all going great. A few weeks ago there were rumours about some jobs being at risk due to a reorganisation.

I received a letter yesterday saying that my job in one that has been identified as no longer existing so I am displaced and must go through the process of choosing 3 preferred roles on a provided closed list. However I can only apply for any in my pay band of which there are none on the list!!!! Looking at the names / paybands of people affected I don't think anyone else has this problem although all will have to choose preferences and there are no guarantees.

I've been told that I will have to then skip the closed list and when this stage finishes I can then select from the open list which means I can go for any payband, but there are no guarantees I'll have a job at the end of it although the manager says there should be with added positions a job for everyone. I feel that I am not being offered the same chance as everyone else.

And HR won't back this up when I ask.

I'm quite terrified as I love my new job and have only been doing this for a few months now.

Not sure what to do apart from panic....

    I am so sorry about your current situation. Regretably as you have not got a year's service, unless you can show discrimination, there is very little you can do.

    Just because none of the jobs currently on offer are with the same pay band should not mean that you could not be given some preference (in being able to apply, that is) over an external candidate or one not subject to redundancy - as long as you are qualified to do the job.

    Are all the jobs at paybands above your own or only below? Are you capable of doing any of the jobs on the "closed list"? Would you be willing to take a pay cut in order to remain in employment with this company?

  • there is nothing I canchoose, it has to be the same payband and there is nothing of that payband there.

    I immediately see a positive here, but obviously easier for me as I'm not in the position you are where it is 'my' job at risk.. But...

    I think you have the advantage of being able to apply for higher paid job roles (if I was you I would ONLY apply for higher paid roles) - you have the advantage of perhaps being given some internal preference as you are familiar with the company etc... and they obviously saw something in you they liked a few months ago when they recruited.

    Your colleagues have to apply to job roles in their current salary band, whereas you have carte blanche to choose the highest paid job role you think you can manage.

    Have you seen their redundancy policy/procedure document? If not, ask for it and check.
  • I cannot choose anything higher or lower. At the next stage any one from any dept in any location can apply for higher, same or lower payband, so no one has an advantage.

    My other concern is that I've not been there that long to have gone through any reviews on performance or had much if any training / experience in other areas.

    It is not fair because you are not able to apply for any job. They should be reconsidering redeploying you, not leaving you to join in a general free for all.

    My opinion (and I acknowlege it is only an opinion) would be that the only reason that is even slightly excusable for excluding you from applying for any of the jobs outside your current pay band would be if the number of vacancies there exactly matched or were fewer than the number of people able to apply. (Whether there are more vacancies than people will depend on the nature of the restructure, of course, and whether there have been resignations recently.)

    Do check their written policy to see if the exclusions are given in that.
