    I came across this on the SRA website: (don't know if it has been posted already)

    It lists the types of supporting evidence the SRA needs when making a claim for compensation.
  • I paid for an indemnity insurence which is amongst lost paperwork does anyone know who WS used for insurence purposes please as I am not sure of how to track down the policy otherwise. Thank you.

    The solicitor who a cted for the other party may be able to tell you as your solicitor may have copied the quote to him in the hope that the other side would pay for the insurance.

    This does say the main claim including the new solicitor goes to the SRA which is different to the seemingly authoritive long post by picklesjsw (maybe new rules for this special case?)
  • Hear, hear! It's quite clear that even among lawyers, very few know the finer points of how the compensation schemes work in practice. We read about them in the professional journals, but that is no substitute for actually dealing with them in practice.

    The Law Society/SRA should have a joint part of their websites setting out clearly what claims can be made and to whom.

    I am sure that individuals at the LCS, SRA and DWF will be viewing this website. It would be useful if they could get together and perhaps post something on this website in plain English about "claims". That would help everyone. I have to say that I am more confused than ever having read the various posts, despite the very helpful one from Judge Pickles.

    As I was a buyer WH insisted the seller paid for the indemnity insurance which may or may not turn up in my file
    I did see a sample quote to the seller before completion and it was from

    Hi it's not that simple I am afraid as the sellers used the Birmingham Office of WS. They worked just around the corner from them. I used them online without realising. We I checked though WS said it was ok as it was seperate offices.

    Oure sale and purchase went through in december and I am now in my new house. However like many others Wolstenholmes haven't paid my stamp duty, estate agents fee's, registered my property in my name, sent deeds to my bank etc. About £20k of my money is still in limbo. We have
    1)Filled in the SRA form to claim back our stamp duty etc
    2)Written to the LCS to see if we can claim damages for all the additional costs, stamp duty late payment fines, money for my re-hab following the breakdown i am likely to have etc.
    3)Written to the indemnity insurers to see if they will pay out for damages
    4)Written to HMRC to see if they will waiver/freeze the interest.

    We have heard back from the SRA saying they have our cliam and will be appointing a case worker. We haven't heard back form the other 3.

    DWF say they can't find our casefile and my new solicitor says she cannot do anything for us without it? Is this true? We cannot afford/do not want to pay out for stamp duty and estate agent until our money had been returned, however could pay some of the land registration fee's etc again.

    Does anybody know what my solictor should do?

    Also is there anything I haven't done that I should have/any funds i haven't applied to that I should have?

    Similar position to you, completed beginning Nov, but intend to claim from the SRA for 1 and 2, apart from the rehab which is the LCS.
    No 4 I will let my new solicitor sort out as when I phoned HRMC they could not help without the UTR number which should be in the WH file, so best left to a professional. If they do impose a fine/interest it will be part of the SRA claim.
    Everything is still in doubt re. monies at the moment as the agents DWF have the power to reimburse if they can reconcile funds so I think it best to let the new solicitor do what he can for now.
