Hello Everybody,
Thank got I found this forum.
I had an nightmare of an experience with a Nasir Ilyaas of this company back in Sept/Oct 2008. He tried to rob £25,000 of my money which I had paid as deposit for a house I was buying. I lost the house but manged to get my money back, thanks to the police.
I hope that these cruel people can be bought to justice and I sympathise with those who have been affected. I know what is is like because I have been threw it.
I hope your problems get solved quickly
Love from Anne-Marie0 -

Thanks Tracie. I now understand Abbey's angst as it appears quite a few of us were with or applied for mortgages with Abbey. Abbey's bank manager is suppose to call me next week to restart my application. I hope I do not have to pay another fee and I note their rates are not as good now as what I was offered before it was withdrawn.
I wish you and your family all the best. I am learning to take things one day at a time although some days are harder than others and at times appears as if I am fighting a lossing battle.
Thanks to Mark Hunter, MP for Cheadle who unlike my MP has taken the time to reply to my email detailing his efforts thus far.
I am grateful to each and everyone of you who have been my lifeline and kept me informed with your postings throughout all of this. Thank you.
Hi Simply Me
I hope you can include the increased mortgage rates on your claim form with the SRA

I've not been on this site for a week or so as I have had no internet access. I am in a very similar position to yourself, but consider myself fortunate in this instance in that my daughter only lives with me a couple of nights a week. I was due to complete on 22nd December and although they have only about half the amounts that you are talking about, they are still very significant figures to me. I am currently taking up numerous offers of friends to stay in their spare rooms and currently have everything in storage, with all my life savings tied up in the SRA's bank accounts.
My question is, can you explain to me how you found out that Stirling Law had you file? At the moment BWF are looking for my file before they can pass it on to my new appointed solicitors (who I have already instructed) along with the necessary funds to finish my completion. I've had no communication from anyone saying that my file was transferred to Stirling Law and as each day passes with DWF not having found my file I'm starting to wonder whether it has been sent there.
Much love and best wishes to you and your family.
Hello Mat, no matter what amount of money it is its still YOUR money!!! Everything of ours is also in storage even the kids christmas presents!!! all our clothes EVERYTHING!! it went into storage and we couldnt get to it to remove anything because it is the storage of the removal company in London where we moved from and obviously im now in East Sussex 2 hours away. They kept on the vans for a couple of days hoping that we would still move and then placed into storage christmas eve night. i had to rush out and buy some presents for the kids and clothes for us to try and grab something back of our already completely ruined xmas. Once the caravan we had founds site closed down we managed to find a cottage to stay in and they agreed a reduced rate with us because of our situation but we only have that till friday 15th so unfortunatly I do know how you are feelingand I sympathise with you too.
I found out that my file was at Stirling Law by accident really The Estate Agents that I have brought through in East Sussex contacted a local agents who were situated about a mile away from Wolstenholmes they confirmed to us that there was no one in the building of Wolstenholmes and it had all been shut up and that they had been told to advise people to contact Stirling Law, so that is what I did i was confused though because as far as I has been told when the Birmingham office was shutting was that my file was being sent to Heald Green on Thursday 17th!!! At first they couldn't find my file and as mine had come from Birmingham not heald green they had no idea I had to complete on that day as they were not told but it was found but unfortunatly this was not untill they day after our supposed completion date.
However I must add that I did manage to speak to Imran Hussain on the Monday and I did know that he did not have my file and had no idea I was supposed to complete that day either although he promised me he would complete without the file and oh well surprise surprise I heard no more from him!!! hence why I am now on this forum!!!
Although do I look at the brighter side was fate looking over my shoulder? I have heard of people whose houses were not registered, stamp duties not paid, estate agents not paid, owed monies not sent to them would I have been caught up in ALL of that if it had gone ahead that day and would my existing mortgage have been paid off!! I doubt it. so am I maybe Lucky??? i'll let you know when all this is sorted
Have you contacted Stirling Law about your file? was it with Heald Green or did it come from another office?
I hope you have still been able to see your daughter x
Much love and best wishes to you and your family too.0 -

too right add it all up over the fixed term if you have one and slap it on and if you have to pay the mortgage fee again, anything else you can think of storage, clothes, phone calls etc anything that you have had to purchase that you wouldnt have had to if this hadn't happened.

Catwoman8950 wrote: »MrWhizz - I am in the same position as you. I received an e-mail from Stirling Law earlier this week to say that they had my file and wanted me to sign a consent form for them to take over my case (also probate). Their attached letter to me was dated 17th December, so before the SRA intervention at Wolstenholmes. I immediately fowarded the e-mail with attachments to the SRA and DWF (the intervention agent). DWF answered me within an hour and said they would retrieve my file from Stirling Law, by court order if necessary. I got the impression that DWF do not want Stirling Law to take over Wolstenholmes' clients and this may have something to do with their investigations.
Because of the way Wolstenholmes transferred my file to another firm without even telling me (which is illegal by the way) and even denying that they had done so when I called them on 15th and 17th December, I smell a rat here. There is a connection between Wolstenholmes and Stirling Law which I am very uncomfortable with.
Consequently I have written to Stirling Law (with a copy to DWF) to refuse their offer and to tell them that DWF will collect my file. I then have to decide who will finish off the estate administration for me. As DWF's fees will be rather high, I will probably instruct the local high street solicitors who are handling the sale of my property. Actually I wonder if we can claim compensation for additional legal fees incurred due to Wolstenholmes' incompetence?
It also depends on how much work is still to be done. With me, it is very little and I may be able to finish it myself. My main problem is that Wolstenholmes were still holding around GBP 10K of my late mother's assets and I will have to claim this through DWF and the SRA.
In any event, I would advise you not to let Stirling Law take over your case. I simply don't trust them.
Many thanks for your advice Catwoman8950. Wolstenholmes appear to have done very little work for me and I am thinking about getting the file back and obtaining the Grant of Probate myself - I don't think that it's too complicated and wish that I had done so in the first place. Hope that all goes well for you.0 -
