    it exists and the address is on the law society website so you can check it there - the best of luck in getting your file back - stand your ground and sit and wait for it if they refuse to give it to you - at least you will then have a fighting chance of getting your conveyancing completed by the end of the month then!!
  • if they have your file why not collect it or arrange for a local taxi firm to collect it - you would have to send a signed form authorising the person to collect the file to Stirling and also to the taxi or courier firm so that they have evidence that they are supposed to collect it - it can then be delivered directly to DWF - that is the only way you can guarantee the file getting there in time. I would speak to DWF about it first the make sure they are happy with this being done - it is your file after all not Stirlings and they have no right to hold on to it.

    hvae emailed them to inform them we ars collecting file in person on friday so they can get it ready and informed them we have spoken to sra/dwf and they have said needed to phone to let them know coming to prepare it and that we had to fetch passports and a bill to prove identity and that they then do not need to send to either office as we are going to hand deliver personally to our new solicitor , and emailed the address that we have got for them in oldham to confirm that is where they are , my husband will phone tomorrow to doublecheck but unfortunately cant go tomorrow im at work ,but as i pointed out they were still dealing with my file this afternoon so therefore my notice comes in time to stop them sending on further and to now wait for our arrival . fingers crossed
  • lady at dwf said get in touch if had problem collecting it if they said had sent etcc. i already said to husband well take all numbers with us to make sure so we can call them from the office

    I registered my complaint with the SRA in October there are many who logged their complaint long before me. When Wolstenholmes was experiencing "technical difficulties" and I contacted them again I found them to be sooooo unhelpful.

    This whole mess should invite a review by government to ensure that consumers are better protected, it is the banks that insist on using a solicitor, it is the banks that insist on having these legal people involved. Some of the most simple transactions could be done by yourself if it was not for the insistence of the banks on having solicitors involved. If there are those amongst us who honestly believe that you will get a better rate of service if you pay £800 as opposed to £400 for conveyancing then I beg to differ as incompetency is found at all levels.

    I also find the standard letters that are being sent out by the SRA and the LCS to be insulting, send me some credible information that will put my mind to rest not a cut and paste job.

    The problem is with these cheap firms is that it often is not a qualified person doing the work - by qualified I mean FILEX, a licenced conveyancer or a solicitor. A trainee solicitor can undertake work legitmately as they are supervised - these cheap quote places have loads of assistants and I do not mean assistant solicitors these are unqualified people who don't get paid much above minimum wage and have little or no legal expertise. Solicitors Indemnity Insurance is higher the more solicitors you have to cover so if you go to a proper firm with solicitors doing the work the overhead that they carry for indemnity insurance (to cover people for dodgy people like these) the practicing certificates that we all have to have as solicitors to do the job alone means that quotes like the ones given by these people are not viable. It is not a two tier system at all - the cheaper ones cut corners - my advice always check the qualification of the person acting on your file - if they are called a case worker/handler they will not be qualified - ask questions its your right to make sure you get good service!!

    Wer r u now? i trusted your words and continued with Wolstenholmes 3 months back!!! If you are reading this thread then pls let all of us know what went wrong...... also whether you guys really carried out those property SEARCHES?? i have never received a statement so i dont know what you guys did and dont ....
    we would like to know inside stories of Wolstenholmes before its closure....

    Anyway i hope you have tried your level best to bring this TITANIC to ??????...

    may have been posted already, but the SRA (sorry, not SFA! Solicitors Regulatiom Authority..) have recently closed this firm down, and suspended several solicitors, amidst an investigation..

    many customers funds frozen pending claims..

  • Confused - if you do not want them to act then just do as the letter states e-mail them back and they will send your file to DWF. The letter is giving you the option. If you do not let them know then the file will stay where it is with no work being done!!!!!!!!!!!!

    Also I doubt that Wolstenholmes knew about the intervention most people don't it states the dept closed and therefore files transferred but no work will be done until consent given or client advises otherwise.

    I would therefore suggest e-mailing the letter confirming the file is to go to DWF and no doubt it will be sent

    DWF are now acting for me in this regard and will deal with the matter. However, the following points disturb me.

    1) Wolstenholmes should never have sent my file to another firm in the first place without my permission. Had I been asked, I would have instructed them to send it to my new solicitor.
    2) When I asked WH where my file was on 17th December, they refused to tell me, or even admit that anything was amiss.
    3) I now know that all the staff at the Heald Green office were being made redundant at the end of December.
    4) It seems clear to me now that the management of WH intended to shut up shop completely and it's a pity the SRA didn't act sooner.

    Nazma left the company a few months before WH went down. I believe she was really trying to get peoples issues sorted but realised she bit off more than she could chew. I found out WH didnt do a single thing on my account for 5 months and only partly refunded my deposit with no invoice attached.

    Please read back a few pages to find out what went wrong with WH, this whole thread is full of usefull information
