    I have checked and it doesnt contain one prescribed condition, however M&S swear blind that it legal binding and is a credit agreement
    [even though its not even mine]. They have even told me to get legal advice coz they say that i will be told that it is ok.

    If it contains none of the prescribed conditions, then it can NOT be binding, gs.
    The fact that it is not yours makes it all the more 'iffy'.
    Take M&S's advice - get a legal opinion - it needn't cost you anything - talk to National Debtline - 0808 808 4000, CCCS - 0800 138 1111, or Community Legal Advice 0845 345 4 345.
    M&S seem pretty sure of themselves - might not do any harm to take legal advice - they have, if nothing else, broken the terms of the Data Protection Act by sending you someone else's agreement.
