    Thanks for the posts and the advice very much appreciated.

    I had a letter in June from Rockwell saying they were collecting on behave of M&S. It has just dawned on me that M&S passed account to DCA when they knew they had no agreement. (I know im a bit slow). I wrote to them in June with a 'Bemused letter' that i found while searching on here, however today i have received another letter from Rockwell from their pre-litigation dept saying that they were going to send someone round and start court proceedings.
    How can they when I have proof M&S said they had no agreement??

    Do i send the bemused letter again??
    If not what do I do next??
    Isnt there a doorstep letter i can sent?? I remember seeing at some point (I think).

    Any advice appreciated.

    Sorry no advice all you can do is either pay up or let them take you to court. It should not be like this but M&S seem to have no morals,we are holding firm on them taking us to court as they should lose.

    It may be worth sending a copy of the letter M&S sent stating that there is no agreement to Rockwell. I know it's only a threat, but if you can get them both off your back that would be great.

    No your right it shouldnt be like this. I will however, like you, fight them all the way even go to court if necessary.

    Didnt think of that when i sent to Rockwell today. Will write a short letter again to Rockwell and put copy in.

  • Well i didnt have to write to Rockwell again.
    Received a letter today from them saying that they are taking no action until they have contacted M&S and all activity is suspended.
    Guess I just sit back and wait for now.

    I have had a reply to the letter that i sent to M&S that George kindly found for me.
    M&S say that they refute what i have said about it being illegible and that there is nothing wrong with what they have sent and have supplied everything they needed to under the cca request.
    But its not even mine!!!!
    Will sit back and see what their next move is.

    They call this legible?????? :confused:

    And you call clearly see that it was a joint application form there are 2 names and 2 lots of salaries ticked also the box is marked for ''married'' I wasnt married i was single. You can only see it because it shows up white.

    (It is actually a bit clearer on here than when you look at it with the naked eye i hadnt noticed before).

    It looks as though it is a copy of an original application form - application forms seldom contain all of the conditions required for a compliant consumer credit agreement.
    You can, as far as possible, check against the list of prescribed conditions:

    I have checked and it doesnt contain one prescribed condition, however M&S swear blind that it legal binding and is a credit agreement
    [even though its not even mine]. They have even told me to get legal advice coz they say that i will be told that it is ok.

    Hi Government slave. Do you have a welfare officer who could help you fight them? It might make a good article for any "in house " mags your organisation has and that could help others.
