Yes, member states must comply with community law, but Comet isn't a member state, it's a private party. And directives can't be enforced against private parties in what's called "horizontal direct effect"; directives can only be enforced against the state.

(I think you're getting directives confused with regulations which can be imposed upon private parties, since regulations immediately become part of national law, whereas directives don't).

by 1st January 2002 all member states must have altered their legislation to comply
