Reclaiming from a closed Halifax Bank account?

Hi can anyone tell me for certain if a bank has to provide you with a list of charges and assess your claim for financial hardship if an account is closed.
I am currently on the phone to Halifax arguing that they should still be providing me with a list of charges I requested and paid for back in May. They state they have no legal obligation to provide me with my list of charges as the account was closed. They also state they do not have to assess my hardship claim as the account is closed.
They closed the account a few months ago and it has thousands of charges on it since 2001?
Is there any legal paperwork of FSA rulings I can quote to them to prove them wrong on this?
Is this a job for FOS to deal with now?

They're b*!!$h1tt1nG. I closed my HSBC a/c Jan. 2006 then requested statements/summary of charges Jan. 2007. They even sent back the £10 note I put in the envelope.
File complaint against them with the Info. Commissioners Office - ICO.
The form is very easy to complete.0 -
I started my claim with Halifax back in 2006, I asked for charges/statements of all accounts open or closed and they obliged happily. They are also considering my harship claim as we speak, on ALL accounts. I sent my initial application/complaint to my local branch where my account was opened and they forwarded it to the correct team. Sounds like you either have an untrained person advising you, trying it on or just completely bulls*itting you. Try again. If you are getting nowhere, PM me and wem ight be able to use my case as an example they cannot treat people differently. All the best.0

Karen, remind them that the FSA did write to them with regards to Data Retention and they have a duty to preserve data. Furthermore, they are in breach of the waiver. Can you ask them for their data retention policy for open and closed accounts before you mention the FSA letter of 19th March 2009 to them re data retention.0 -

Hi I tried that approach this morning as I quoted the FSA Waiver sent out to all bank recently - but the guy said that he cannot comment and it was the banks decision to not investigate claims on closed accounts.
I also mentioned the fact that numerous people on here have had payouts on closed accounts so I couldnt understand how they can pay out on some closed accounts but not even look into other requests on closed accounts.
He said he was unable to comment on other peoples accounts due to Data Protection blah blah....its just one excuse after the other!0 -

You need to ask him to write to you to state that the bank WILL NOT send out bank statements on a closed account regardless of the reason so that you can take your complaint to the Information Commissioner's Office.0 -
it is totally irrelevant what has happened to other people, cos they aren't you. But they cannot refuse to give information out.
EDIT: call the ICO on 01625 545745. Explain you asked for statements on a closed account and tell them the date it was closed but the bank is refusing to give you bank statements on the account. Ask for their advice.0 -

I have already done this. I got in touch with ICO and FOS on Wednesday, its just so infuriating that that both of these routes are now going to take another 2 to 3 months to get anywhere.0 -

Just a thought - are you speaking to the same person at halifax each time. If so, can you speak to someone else or ask to speak to the Manager in that department. I take it you sent off the original template letter asking for statement etc. Did you do this before the 'hold' ?0 -

My original claim to Halifax was in September 2007, but then after losing my job in April of this year I sent a letter asking them to look at my claim for harship. They wrote back pretty quickly saying they see one of the accounts is closed, so they can only assess the open one.
I have been speaking to my case worker and the guy who originally wrote to me and both of them say its company policy to not look at old accounts.
I have lodged a claim with the ISO and FOS but this will take months now I am sure.
I originally asked for the list of charges for both accounts on 19th MAy 2007 with a cheque for each. They wrote back saying they wouldnt bank the cheque but would give me the list free of charge but I still have not received a list of charges on either accounts to date!0 -
this doesnt bode well as I notice we are both at the same stages of claiming. Thanks for the response to my letter from Halifax. They havent said yet that the closed account they provided the evidence of charges for is not included, everything indicates they have included it. I hope they do as it is the account that started my situation. My initial claim for charges was 06/07 and hardship this year April 09, I have received the same letter as you today, yet so far I have no indication they are not considering the closed account. I'll keep you posted.0
