Ebuyer - advice needed urgently!

I was expecting a delivery of a Robosapien from Ebuyer today and took the day off work especially as it's my son's main Xmas present. We're off to relatives for Christmas as soon as it arrives but time's (obviously) running out! The courier hasn't been answering the phone, the tracking number doesn't appear to exist and I'm getting a little worried :-[

If it hasn't arrived by 6 (end of their stated delivery window) can I go and buy another in a shop tomorrow (when I'm 500 miles away) and send the one I ordered back after it eventually gets here at no cost to myself as they are somehow in breach of contract? I don't want two, a disappointed child or to pay a fortune to get out of the situation!

Help!! ???
If I hadn't seen such riches, I could live with being poor...

    I have had an order waiting (items in stock) since the 12th. A separate item not that robot thing. Enotes forget that I have one unanswered since Monday dinner time.

  • They haven't breached the contract at all.

    If you send it back and it works, you will incur a 20% restocking fee but you will get a refund.

    and how is this a bargain thread? ???

    I had the same problem. Took a day off but no delivery. Their terms and conditions say they are not liable for 'reasonable or unavoidable delays'. So far they've given me the P&P back but I'm waiting to see what the reasonable or unavoidable delay is as they don't seem to want to justify that. You can send anything back within 2 weeks for a refund (if I remember rightly), but if you ask them to agree to a refund of this postage they may do what they did to me and delay the reply to the e-note until you've no choice but to post it regardless, to avoid missing the 2 week deadline. Get a receipt for postage costs just in case.
    So worst case should be you are 'out' the cost of sending it back. :(
    Just seen the previous post ' they have broken the contract if they can't prove that the delay was 'reasonable or unavoidable' it's in their own terms and conditions.
    All the World is a Stage; and I'm going through a difficult one at the moment!
  • Have you had the 'order despatched' e-mail? My robosapian arrived on the 'deliver by' date and I could find my order by looking at the account section (details e-mailed when I first joined) I had three e-mails, order acknowledement, order confirmation and order despatched. I ordered mine on 15th December. Also, on the acknowledgement it states:

    'Under the new distance selling regulations you are entitled to cancel this contract with Ebuyer within 7 working days after receipt of goods and receive a full refund. This law assumes that the goods have not been used and are in pristine condition.'

  • I had a similar experience, which is why I always tell people on these forums that IF YOU NEED SOMETHING URGENTLY, NEVER BUY FROM EBUYER. They are not at all reliable.

    Have fun trying to get your money back too. They told me to refuse delivery when the item got there and a refund would be with me within days... I had my grandparents refuse delivery when the courier turned up with it. 2 weeks later, the item shows back up at the house and my grandparents sign for it not knowing that it's the same thing they refused 2 weeks ago. That's where the problems began... ebuyer refused to come and get it, and demanded that I send it back recorded delivery and bear the cost of it! Out of principle, I refused, and they were adament that it was my fault and that I shouldn't have ordered the item if I didn't want it. I've never wished evil things to happen to a call centre full of people as I did in those weeks trying to sort it out.
  • Sorry Adamzetec, I knew this was off topic but as the kids and I are sat here on our suitcases waiting for the doorbell I needed some advice urgently. :-/

    Thanks for all the help, I think I'll just have to buy another and try taking the first one back to the second shop if possible. It was the cost of posting it back that was worrying me (have you seen the size of it?) and the fact that it now probably won't be delivered until at least Jan 5th due to being away til New Year and the 3rd & 4th being public hols here.

    Oh well, I tried...

  • I have been waiting for a laptop. Delivery should have been friday but got this email on thursday:

    Dear NERRAD

    Owing to the Christmas rush, we have received a dramatic upturn in our order volumes. As a result of this demand, your order has been delayed in our warehouse and will therefore not be delivered to you by your expected delivery date. Rest assured that your order will be shipped first thing in the morning on a next day service at no extra cost to you the customer and it will arrive to you one day late.

    Please accept our sincerest apologies for the annoyance and disappointment you have been caused by this temporary delay of service.

    Thank you for your patience and co-operation in this matter.

    So now its wednesday and still no laptop, no reply to enotes (sent sunday)and no phone number to complain.

    It was for a birthday present TODAY.

    Crap service along with the store, Staples and Empire. >:( >:( :'(
