Ask the photo people for a couple of names of people who has had their photos back and see what reaction you get.

I wouldn't be contacting my bank just yet and definitely not under the CCA. Why? Well, it may move the supplier to actually send the photos and then the contract is complete.

This is me assuming you don't want the photographs at all now, but if you do then use the CCA.

If you don't want the photographs then I'd be looking at the Consumer Protection (Distance Selling) Regulations 2000.

The OP seems completely genuine here so what is it you actually want? Money or photos? Please remember you have not be scammed or conned. You agreed to a contract. Yes, you were taking advantage of but you sound of sane mind and I'm sure you are a nice person who is a bit of a dreamer (like most people who think they can be a 'model'). So (so far) it doesn't mean the company conned you. Take responsibility and learn from it.

I agree with Yorkshire Boy and Jemma.

A/ it is too soon. Or did you sign a contract with them? What do they say in it? 3 weeks or 3-8 weeks? Are they actually late yet?

B/if they deliver the photos the contract is completed. Just because you think that it will not make you a model doesn't mean they are con artists. It depends what is written in a contract really. I suppose you signed one?

If they said - "we will make your photos" and they deliver, you just learned valuable life lesson.

Also remember to check your credit card's T+C to see if there is a time limit on requesting a chargeback. My amazon mastercard (administered by the Halifax) stated a chargeback should be requested within 8 weeks of the original purchase.

After having searched the forums for months, I finally need some help, so i turn deperately to you guys.

Well, what can I say, I have a feeling that I may have fallen victim to a modelling scam...

About 3 weeks ago I went down to london to register with a company called lovin models. (Website: www .lovinmodels.co.uk)as they had contacted me through starnow ( a casting website, which has shown to give me 100% reliable results up until this point)

But now I think you can see where I'm going.

I went down, had a photo shoot so that they could put together a portfolio for me, and while it usually costs them £1500 according to their price list, I got them down to £600.

While with hindsight there should have been red alarm bells ringin, they weren't. The man made it sounds so convincing and up untill the point where I had to purchase my photos, it all seemed to be going well!

Well yeah £600, which my mom charged on her credit card in two payments. One on the day, and the other half (£300) was arranged to be taken today.

For some reason I now have a horrible feeling that they are con artists, and was wondering if there was ANY way I could get the money frozen, or transferred back into my moms account (ie, if i tell her she needs to ring up.)

One thing that may help me I think, is the fact that I was told within 3 weeks I would recieve all of my photos, and there has been nothing. Having charged us £600, I called them up today and asked what the progress was, the receptionist seemed like she could be bothered to answer, and told me it takes up to 8 weeks, and so she'll check the status for me and then ring back.

Please please please let there be a solution, I can't believe how stupid I was looking back :(

What exactly were you expecting from them?
I would guess if they send you a pile of photos you have got what you bought and the CC company will not have any liability.

No, they could still do a s.75 regardless of contract completion because item was not as described then they can claim under s.75 CCA. (i.e. a photo vs a modelling contract are two different things entirely!)

DSR2000 is irrelevant, maybe you need to read the actual policy! Only relevant for CNP transactions - the OP went to the studio so DSR is void.

If a company state they will give you work and charge you £600 or whatever, and do not provide it then you must claim under s.75 - nothing else will allow for recompense.

If DSR2000 was valid the OP would have been pointed in that direction long ago!

It does not appear the OP was ever offered a modelling contact. Where did that come from?

Here - exact quote! The OP didn't spell it out, but she did imply it several times!
