Claiming a credit card chargeback

Hi,
I am hoping for some advice.. I bought an item online, it was delivered last week. For several reasons I was not happy so checked my rights under Distance Selling regs with trading standards. They advised me to send a letter rejecting the goods etc. plus that because I paid by phone and they never pointed out any terms and conditions that I would not have to pay anything to return it ( not had any paperwork regarding my purchase from them at all) Today I have had an email from the company saying they will not refund if goods have been opened from original packaging or used. I emailed them back and said that I was allowed under distance sellings rules to inspect the goods and that I have not used it at all and if they still would not refund I would claim a chargeback from my credit card company. They have not responded to this but I am very worried. I know I have not used it but what if they try to say I have? Would this stop me getting the money back from my credit card? I have not been able to post the item back to them as it is very large and I asked their advice on how to pack it.
Has anyone ever been refused a refund and then claimed from their card? How on earth do I prove I didn`t use it? I`m sorry I know there may be info on various threads here but I am so upset by this I feel ill.

A mattress. It was delivered rolled up like a sausage so impossible to inspect it without opening it, but I have not used it. Now I don`t know how on earth to re-pack it.0
