Do not use paypal with your credit card! Invalidates insurance

I just tried to have a payment refunded on my credit card as Valley Optics had sent me faulty cheap reading glasses and would not offer me a refund even though I had returned the goods. They just sent them straight back with a rude letter.

I had claimed through Paypal and they said they only make judgments on whether an item has arrived rather than the quality!!!???

So I phoned Barclaycard, they could have refunded my payment under my normal terms and conditions of use under faulty goods BUT because the transaction had gone through paypal they could not!!!!

I'm disgusted!!!:mad:

    Could you not complain to Paypal and say that the irony of all of this is that you couldn't read all of their small print and thus know this clause existed; simply because you didn't have good enough reading glasses.
  • They were nothing ;like description! But apparently this is only covered if you buy them through ebay and not any other site that uses paypal!!!

    I have spoken to paypal, just got off the phone and they said everyone should read the small print that the buyers have no protection off ebay BUT that nowhere does it say that it invalidates your credit card insurance.

    It doesnt help you at all, but strictly speaking I don't think it's that your credit card insurance is invalidated, it's that what you used your credit card for was to put money into Paypal, NOT to buy the glasses - you did that using Paypal. It's viewed as two completely separate transactions, and the Section 75 protection only applies to the first part, as the credit card wasn't involved in the second.

    Also, regardless of how you paid for them, I would have thought that you should be protected by the Distance Selling Regulations ? Is it a UK based site ? If so might be worth having a word with Trading Standards

    I had a similar thing a while back. Bought a pair of "genuine" Ugg boots from ebay for over #100 but they turned out to be fake - confirmed by an official retailer. Ebay weren't interested and neither were paypal. Tried to claim through credit card but because payment was made through a 3rd party, i.e. Paypal, LTSB wouldn't touch it. Trading Standards said they couldn't really do much so 100 quid out of pocket ...... lesson learned :mad: x

    I had MBNA refund me Eur 1200 after paying via Paypal for a piece of equipment from Germany that was faulty. This was nearly 4 months after the transaction as well.

    Where do I find out about the rules of distance selling?

    Look at claiming through DSR2000. Distance Selling protects you (usually) when all else fails.... especially if mis-sold or mis-described.
