Hi

I got my fiance an i phone for Christmas in my name and agreed to pay the first 3 months (i had already bought him other stuff) and he agreed to pay the rest. Since then he has lost his job (made redundant), we have split up and he said the dole havent paid him since March which I find hard to believe as he wasnt sacked.

Since then he is now 3 months behind and cant pay and keeps giving me different storys every week as to why not. I really cant afford to pay it but have said we can send the phone back cancel contract and pay the rest off. He then said he wanted to keep the phone and will pay it.

Since then he has sold the i phone which I didnt know anything about and now its even worse.

Can i report this phone as stolen? What can i do?

Please help

Depends if he can prove you gave it as a gift but i'd have thought in theory the phone is yours as the contract is in your name so you could get the phone barred if you can get the IMEI number
  • But if he has sold the phone on to someone without my permission surely I can put a full block and tell o2 its stolen?

I don't think its a good idea to tell them it's stolen, that could come back and bite you. But you could tell them you can't find it, which is true...

Even if you report it stolen they won't cancel your contract, they'll just send you a new sim and the contract carries on, sorry.

Who has he sold it to? Friend/ebay etc? He has sold it already so the only person it will affect is the unsuspecting person who has purchased it!

Yeah but its something he shouldnt have sold, might make him consider paying something if the other party tries to sue him
