Not sure if this applies anywhere outside of Glasgow. Most tenements have factors who look after the communal areas and sort out the buildings insurance. For this they charge a small fortune. I'm sure I didn't sign anything when i bought my BTL flat. Now I need some information from them, and they won't answer any questions as they say I owe them service charges. They are rubbish and never get anything done properly, but it needs agreement from all the owners to sack them, and we can't do that until they finish the work they billed us for a year ago.
Anything I can do about it - specifically can they send me bills if i never signed anything?

When I lived in Scotland, the Factor had a standing monthly fee of £14 per month and would notify all owners of any repairs needed above £150.
When it was self-factored, no owners were interested in getting quotes to fix any defects.
The housing law that governs property in Scotland makes it mandatory for owners to be responsible for the upkeep of the common areas - backcourts, closes, roofs, door buzzer, etc.
Like the payment of council tax, it does not require your consent. If you do not pay your share, then they will take you to court.

Govan Law Centre's senior solicitor Mike Dailly has a specific knowledge of all things Factor, so it may be worth you contacting the centre for advice.
Glasgow MSP Patricia Ferguson and Consumer Focus Scotland have also campaigned on problems with Factors, and the need for regulation, so you may get some further help there.0 -
If the factor belongs to the Property Management Association Scotland, then look up if they have a dispute or complaints service.
Other than that, have a look at the tenements act 2004 and your deeds.0 -
Thanks for the info. I'm as stuck with them as i thought - for the meantime. I've never once heard anyone recommend their factors, but these guys take the biscuit.0
