Lloyds - unsure what to do

I don't know what to do. I seem to be incurring charges on my LLoyds CC at an alarming rate and have got really behind with my payments, so much so that I now have a default notice on my record.
I want to try to claim my charges back, although from reading on here, Lloyds are not very co-operative anyway.
I haven't sent for my statements/list of charges yet, so don't know how much I will be able to claim. Obviously, whatever I do manage to claim will go towards paying off the CC debt.
What worries me though is that I have a current account also with Lloyds on which I have an overdraft, the overdraft is due to be reviewed in November. If I put in the claim for the CC charges back, are they likely to not renew my overdraft facility as I would not be able to repay it?
I will probably also be wanting to put in a Bank charges claim too, would this be likely to affect my renewal of the overdraft facility?
I have got a couple of other bank accounts, but not with the same amount of overdraft facility, so no chance of moving the debt to them.
As I have now got the default note on my credit account, it would not go down well with a credit score, so unlikely to be able to get any other account or credit.
If I claim my CC charges back, can I ask them to take the default notice off, as it was due to the charges that I got way behind with payments, and at the moment, I am unable to catch up. What is the chance of them taking the default note off the account?

Any help much appreciated.

    Hi folks

    Just to mention even though you can try to reclaim on the bank charges, if you were also sold ppi, known as payment protection insurance with the credit, you can also try to reclaim on that as well, but keep it separate to the charges side of things.

    Hope you don't mind me mentioning this on here, but not everyone realises this is optional and with lloyds TSB they are one of those that seem to add the PPI to cards, loans etc and so on.

    It may be worth checking on your agreements if you have these.

    Good luck and please ask for help when required, there is also a separate thread on here for reclaiming on the ppi if you believe you may have been mis sold this for any reasons and there are lots of them.;)

    The CC had PPI insurance on it, but when I got behind with the payments I got a letter saying it was being cancelled, which I was really pleased about anyway as I did not want to be paying it.
    I really don't know if I was mis sold it or not, I can't remember whether I was asked if I wanted it.

    You can try checking this on here, there is a checklist and if you think any of it occurs to you its worth you trying to reclaim with what you have paid in.

    Do you know how long you were paying out on the insurance?
    Even now its cancelled you can try to reclaim the PPI you paid and the interest.

    It may have been added without your knowledge, in my experience this is Lloyds all over.

    Or you may have a pre -existing medical condition, where if you were to claim on the insurance they would not have paid out.

    You may have had protection through your employer, there are lots of reasons, so its worth checking the link above.;)

    Ask for help if required.

    There are templates on the link, if you decide to reclaim, then use the templates as a guide but write your own reasons.
    They have 8 weeks in full to respond, again Lloyds are always last minute.

    Mine did actually go as far as the Financial ombudsman service (FOS), as Lloyds added the PPI to my CC and I was a home maker, so I would not have been eligible to make a claim anyway.

    Although Lloyds did state I could still try reclaiming on the life cover and the hospitalisation, also job solultions, but paying out for a full PPI was just not on where I was not completely covered, this was what the FOS said and one of the reasons why I was successful through them.;)

    I really can't remember if I was asked if I wanted it or not, I can't imagine me volunteering to pay that amount a month, so it was probably just added, but I couldn't prove it and it was probably on some communication or other. There's no medical things to have it wiped off for.

    Have you requested a Subject Access Request (SAR), where they must supply all the information they have on you?

    They have 40 days to comply, but there is a cost of £10 postal order or cheque payment for this request, below is the link to the SAR template if you want to do this, sometimes some interesting information is enclosed, and about the PPI.;)

    If you have for example 5 loans with them, then they should supply all the copies of paperwork and calculations etc etc.

    your welcome.

    When you request a SAR, say for instance from Lloyds TSB they should supply you with everything they hold on you in the last 6 years, but they should come in handy and help for "any" claims you may have.;)

    The banks banking code states that customers must be treated fairly, I have been with Lloyds for a number of years and have had a few reclaiming complaints with them, infact all of PPI related, we have an hefty overdraft with them of 5.5K, you should be okay.
    In regards of defaults I am not sure, you could post to natweststaffmember on this bit if you want to, he may know more on this one, in regards of defaults or post on the DFW thread above.

    £10 cheque or postal order will cover it all, you should receive the statements and charges as well.
