    did you recieve the goods under 7 days ago?

    if so send everything back for a full refund (inc delivery both ways)under dsr and re order everything

    Well THAT won't work if they are insisting that three hinges were sent...and bear in mind that the supplier is being somewhat unco-operative anyway.

    A refund is enough.

    As for matching door hinges. Do people often inspect your hinges to ensure they match?


    The OP has gone to a lot of trouble (ie not popped out to the nearest multiple) to select a SET of door furniture. Moreover refunding for the ONE undelivered hinge means the OP has paid for two hinges that won't be used...

    By that argument you could have a kitchen fitted with unmatched doors. OP has paid their money and made a choice. No reason why he/she shouldn't have what he/she wants.

    S'not a hinge that's the issue - it's a broken contract...

    Sorry to disappoint you, but some people spend a little more on their property. I used to know a guy who had his own iron mongery and forge, that in case you didn't know is where they 'shape metal' ;), he got an order for a simple 'gate' and quoted some price in the thousands.

    To me it was 'How much for a gate?' He went onto explain the 'gate' I mean how much can a gate cost, not thousands surely!? Then he explained to me the amount of work that was involved, the 'crest' that was going to be put on the gate, the intricate iron mongery involved, the amount of man hours and effort.

    My point to you is that 'a hinge may not be JUST a hinge'. Hopefully you will understand, also we don't know what the OP's setup is, not everyone buys a generic hinge, paints over it and then considers the job done. There are those of us that want the whole matching set; finger plates, escuthcheons, handles, hinges etc whether for historical accuracy or whatever. So once again, a hinge may not be JUST a hinge!

    My goodness me, thank-you so graciously for putting me in my place. The OP didn't give much away when he explained about the hinges. Obviously I'm not qualified to know what a hinge is and you are quite obviously are so I will leave the expert advice to you. However, the OP already advised in their first post that they may have to go out and buy new hinges so I suspect that they are easily obtained elsewhere.

    I'm with Hollydays on this - if the goods have been ordered online then the OP can exercise their right for a refund under the DSR's thus not needing to go down the court route. And yes I did read the OP's post (believe it or not I am able to read despite your assumptions). I suggested dialogue with the company again which, in my opinion would be a better solution.

    Just an update for anyone who may have had a similar online shopping experience, I contacted Consumer Direct, their view is as follows;

    Thank you for your enquiry to Consumer Direct dated 27th June 2009. Your reference number for this case is xxxxx and should be quoted in all further correspondence regarding this case.

    Based on the information you have provided the key legal points in response to your enquiry are as follows:

    If the trader is in breach of contract by not supplying the goods to you the law insists that the trader restore you to the position you were in before the breach of contract occurred. The choice is which remedy the trader chooses is up to them. In this case that may be that you are refunded the money that you spent on the hinge you are missing. By replacing the missing hinge the trader would incur the extra costs of postage and packing which may be why they have chosen the course they have.

    If you require any further advice or information about this case, please do not hesitate to contact Consumer Direct on 08454 04 05 06 quoting the case reference number.
