    Well you can't get a unpaid item strike now. That was the sellers only shot at getting their fees back, so they'll still have to pay them now whatever happens, and there's no action that can be taken against you.

    I had a bit of a different problem in that I had paid for an item but the seller relisted. I reported it to ebay and had my money back via paypal.

    thank you! i feel bad about doing this as i am a seller too, but i am always honest in the describtions and i think the misleading was on purpose as there is clear statement that he he is happy to sell separately and after the auction finishe the 3 seater was gone. He should've put a reserve or put a higher starting price.

    The seller is wrong whatever he claims.

    You thought the listing was for both items. The indication that the seller stated in the listing that he "could sell them separately if required" also backs up your belief. I don't know the listing in question, but suspect ebay would also decide the same way.

    Even if you were wrong then the seller should have listed the item as a multiple item listing. But he couldn't as a 2 seater settee is signficantly different to a 3 seater settee. If he had, and 2 people won, how would he decide who got the 2 seater & who got the 3 seater and more importantly how would the bidders know in advance? That's why there is an ebay policy prohibiting such practice.

    Just report the seller for non-performace.

    If you expand the additional information part in this link, you'll see it's not necessary to have paid for the item. (sorry to have confused you earlier by my thinking it was necessary :o)
