How is she getting away with it??

Hi all.
Im a little bit miffed to say the least. My brother and his missus have just split up and I have discovered, through talking to my bro that she declared herself BR 5 months ago which has destroyed his credit rating and to add insult to injury, he is now responsible for most of the debt which may result in him having to declare BR himself.
My gripe is this: how is she being able to work and get away without having an IPA?
It is my understanding that you have to declare any change of circumstances within 21 days to the OR.
Im led to believe that she wasnt working at the time of BR but has since found work and has been working for at least 3 months!!!!:mad:
She doesnt deserve to get away with this after the trouble she has caused (and lifestyle she led)!!
How is she getting away with this and is there anything I could do to "accidentally inform somebody".
I thought the OR would be onto this sort of thing in a heartbeat!!
Im about to go BR and I will have to have an IPA due to finding work so why shouldnt she????

Well. You can either report her - find her ORs details from the insolvency search as you will know hers.
Or you can just leave it be. You assume she has not told the OR and assume she is not paying an IPA; she may be telling your brother fibs that she is not just to rile him
Working does not necessarily mean an IPA. It depends on income compared to outgoings. So a low income will result in no IPA whereas a medium one upwards would get one.
If you are sure, then report her.0 -

Whilst I can appreciate that it may be galling, and she may have lived the life of riley and caused untold trouble, bankruptcy is not about punishment. Bankruptcy enable a person whose debts are overwhellming the opportunity of a fresh start, whilst at the same time ensuring that an independent person (the OR) is able to ensure that available assets are fairly distributed amoung creditors. The "punishment" comes in the form of a BRU/O if the OR feels she is sufficiently to blame for her situation, or has acted fraudulently whereas the IPA/O is no more than a way to realise funds for creditors.BSC 2710

Anger is a good clouder of judgment, even if the anger is warrented.
As the others have said, how do you know if she earns enough to warrent an IPA (if she is spending as though she has, dont take it as read she actually has such surplus)
You say she went BR 5 months ago, so should not be discharged yet
She may have reported it to the OR, it can take months to deal with it, so she may be 'just making the most of it' untill the OR gives an IPA.
Does not make it right, or help you feel better, but before you jump to a conclusion (that may possibly be right) Just try to remember there are many other scenarious, try getting as many facts (and not just from her ex, who may be exagerating the situation thru his anger, understandably) It will help the OR uncover any lies, if there is anyThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

My bro tells me she earns in excess of £1200 a month after tax and has a "VERY HEALTHY EXCESS" and is not the sort of person to declare anything (especially to the OR)!!! Trust me, the dealings ive had with her in the past tells me she isnt a trustworthy or responsible person and thats the part that annoys me most.
She has chosen BR as a quick fix and doesnt care about the consequences or how she has affected other people (including my parents who trusted her).
It amazes me how the OR hasnt cottoned on to it but as I am well aware, they are extremely busy at present so it might just be a matter of time???
A quick check of her NINO would reveal all to the OR anyway.;)0 -
If you really want to make sure all is kosher, first check her out on the Insolvency service register

this will show you the OR who is dealing with her, the rest is up to you.0 -
If you're really that positive then report her - it's that simple. £270 a week is not always a lot, its all relative, to me, supporting a family of four, thats not a lot, if she has no commitmants, its a lot, you dont give inough info for anyone to comment im afraid, IE rent, CT liabilaty, travel for work expenses, type of property, to base running costs on etc etc.
While i agree you should report it if you have doubts, make sure your right, as she will guess its you or someone else close enough with a grudge (sounds like that may be a long list though:p)

I think the right thing to do is report her but not until I know for absolute certain that there is something amiss.
Personally, I would say she was hiding her working but wont jump the gun.
She has two children from a previous relationship and I wouldnt want to put her children into any kind of hardship just because their mum is irresponsible and puts herself before her kids (seen it with my own eyes):mad:
