Orange Contract - My Rights?!

Hi there, I took out an 18-month contract with Orange in february as I already had a broadband package with them. I was told in the shop that with my new contract, I would be able to recieve free home broadband. This was not the case as I don't live in an Orange area. I now want to cancel my Orange broadband package as there has been a recent price increase. What I'd like to know is that as I feel I was mis-sold my mobile contract, am I able to cancel it without paying the outstanding balance? I do not want this phone, or make much of a dent into the included bundles (minutes and texts) . The customer service I've recieved has been rotten, and would like to know if I were to take this above Orange's head, would I have a leg to stand on?

Thanks in advance for any advice, I'm really not sure where to turn!

    I agree with you completely on Orange's customer services.

    I'm not completely clued-up on the legal aspects of contracts but I'm pretty sure if a company has given you clear written notification well in advance of any price increase, they unfortunately are in the right I'm afraid.

    If Orange told you in the shop that you don't live in an Orange enabled area and didn't tell you there was an additional charge then we are entering questionable territory - you may be OK in this case.

    Like I said I don't really have that much knowledge about this, sorry mate.

    When the 3 mobile network annoyed me so much within their 14-day cancellation period, I told them to cancel the contract and they didn't. I even sent my phone back to them within those 14 days via Special Delivery and have proof it was received by them. So I cancelled my Direct Debit and have been laughing at every 'debt' letter since. 3 are utter morons. :)

    And I'm laughing at the fact that you'll have a great big default attached to your credit file. Oh happy days.

    Sounds to me like you want to cancel the contract because you don't like the phone and aren't using the tariff, so are just regretting your decision to take out the contract. That is not a valid reason to cancel.

    That's what I was worried about. The main reason I went with Orange and took out the contract that I have is because I was told by the staff in the shop that I would then be eligable for free home broadband. As this is not the case I feel I was misled and mis-sold the contract.

    I've been with Orange since it was Freeserve, before you had to live in an Orange area to be eligable.

    I don't want any more credit, don't need any more credit and could certainly live a fulfilling life without some 'credit file' describing how much of a risk I am to lenders.

    If no lenders are going to see my ugly credit file in the next few years, then who is there to see it? Who is there to care? All defaults and CCJs etc get wiped off your credit file after six years.

    I trust you will be applying for a mobile contract within the next six years, or moving house, either rented or with a mortgage? If so, you will be credit checked. You need to sort this out, the only person it is harming is you.

    OP, I am also confused as to how you are receiving Orange broadband if you are not in an Orange area!
    Gone ... or have I?

    Think the OP means her telephone exchange is either non LLU or there are no LLU spaces left. Basically this means that she is still able to get orange BB but not at the reduced price as they are having to use BT's equipment at the exchange.

  • That's it, the telephone exchange has not yet been unbundled, which is the reason that I do not qualify for free home broadband. This was the main reason I took out my mobile contract, but the guy that sold me the contract in the shop did not check whether my exchange was unbundled or not, (I didn't know it mattered, as I was getting home broadband from Orange anyway)

    You need to take it up the area manger of the shop. The guys you talk to on the phone when you call CS are nothing to do with the shops, retail is run as a separate division and the CS agents have no control or ability to change anything they do.

    Orange can not unilaterally change a term such as price without your agreement.
    It makes no difference if they write to you or any clause they have in terms and conditions.

    They may breach the unfair terms in consumer regulations law if they try and enforce this.
