bit of an update.
my grandad doesnt have any estate in spain so we are okay with that they just spent alot of time there on holiday but lived with my parents in england when home.
my grandma went to see a solictor yesterday and now has probate too. from information i found out last night the daughter doesnt even know about probate she seems to think she can just go to where ever show the will that says she is executor and get the estate. the solicitor is sending them a letter requesting a copy of the will as the will my grandma has says funeral costs are to be covered by the estate but the daughter says the one she has doesnt, so my grandma or rather my mum is now footing the bill. this is all that matters to us that the funeral expenses are covered and if it means after everything noone gets nothing and we still pay for the funeral we dont care as long as the money grabbing heartless daughter of his doesnt get anythign she doesnt deserve.
my grandma has changed her pension things to go inot her bank now and we have been to the banks t explaint he siuation and the entire estate is frozen at the moment. from visiting the bank yesterday we have found that 2transactions were carried out last week £267 on 15/06/2009 and £167 on 19/06/2009 the first date my grandad was still in hospital on high dependency ward and the friday he was unconcious all day at home. the funds have been transfered to the daughters husbands account and the sons wife's account. the bank have given us the numbers for the fraud department to log this with them and the solicitor is also requesting the funds to be given back as they were takign without permission because at no point was my grandad in any fit state of mind to give authority for this. After a little investigating myself last night i have found that his daughter is using his email address at the moment to contact people regards to his estate.
not even 5HOURS after my grandad passed away on monday(heartless i know) did she email a friend of my grandparents who deals with a lodge policy he has stating that her father had passed away earlier that day and she was executor to his will and wanted to know what she had to do to get the money. she has sent another email to that person again last night requesting again, what she doesnt know is how friendly the person is with my grandparents and has contacted my grandma straight away and the policy he has has nothing to with the estate until 20% has been paid to my grandma the rest goes to the estate but he now knows the situation.
they have also emailed someone asking for her mobile number as they have a few question regarding the will. would give my right leg to know what these questions are thinnk they may be getting worried that my grandma isnt as silly as she looks and knows the will is invalid.0 -
Sounds like someone will get their deserved come uppence!! :T0

Do I understand from all this that there is no valid will - earlier wills weren't properly signed therefore not valid?
In that case, as grandma and grandad were legally married, she is his widow, his next-of-kin and most - if not all - of grandad's estate comes to her under intestacy rules, as his surviving spouse/widow. Unless it is over £250,000, children/grandchildren/great-grandchildren come nowhere. See http://www.inheritancedisputes.co.uk/intestacy.php
Might be an idea to take all this to CAB and see what they say.Ær ic wisdom funde, ær wearð ic eald.

yes thats correct the will was not signed correctly therefore not valid however my grandad made a previous will years ago when he married my grandma noone knows what this will states. we are trying to locate this now with the solcitor. the invalid will is the one that included grandhcildren great grandhcildren etc and we know that as its invalid noone will receive anything what we are tryign to do is trace the old will as if im correct it should revert to this if not as you say my grandma will get everythign being his next of kin.
we are not interested in receiving any beneficiary from the will we just want to make sure his daughter doesnt get her theiving hands on anything else she isnt entitled to as said in previous posts she has already taken funds from his account via online banking to her husbands account and sister in laws account0 -
The moment Grandad died his bank should have been informed. No one should be able to access that account after his death. A death certificate needs to be sent to the bank so that they can close the account. Also inform the Pensions Service so that they can stop paying his pension into his account.Ær ic wisdom funde, ær wearð ic eald.

no you seem to be confused the previous posts state that my grandad sadly passed away on monday evening. his banks have been informed of his death with death certificate etc as soon as possible. the funds that have been transfered were done before my grandad died last monday 15/06 and the 19/06 please read previous posts for a clearer view0

I am sorry, but your writing is quite unclear and difficult to read because of: no punctuation, no capitalisation, no proper sentences etc.
If you want to avoid confusion, write more clearly!
In any case, no one should take money from the account of a sick and dying man, assuming he was too ill to give his consent. This is absolutely reprehensible and deplorable behaviour.Ær ic wisdom funde, ær wearð ic eald.

I am sorry I didn't realise I was in an English lesson or that the PC police would be inspecting my posts.
My point was that if you read the previous posts you would CLEARLY see that the dates the funds were transfered were 15/06/ and 19/06, before my Grandad passed away.
I think I will look elsewhere for help and advice, as I dont appreciate being attacked in this way when I am only seeking help.
The saying "if you dont have anything nice to say don't say anthing at all!!" springs to mind.
is that enough punctuation and capitalisation for you !!!!!!!!!!!0 -
Margaretclare - actually I found the OP's posts quite clear. It may be helpful to allow a little leeway to someone who is upset. I agree, however, that taking money from a dying man's account is beyond the pale.
OP - I hope everything gets sorted out for you.Ankh Morpork Sunshine Sanctuary for Sick Dragons - don't let my flame go out!0 -
thank you for that appreciate it.0
