Setanta Query

I decided to take out an annual membership around four months ago as there was a pretty decent saving over paying monthly.

Doesn't look like such a great choice now right enough as they have entered administration. I paid the subscription by Visa, is it worth contacting my lender (Egg) to see if I am covered?

Payment was for £120....

    No not worth it.

    You have only lost £80 and so you are not covered.
  • And worse it is likley that this payment is considered to be a CPA (Continuous Payment Authority) and there is no answer to the phone to try to get them to stop taking payments - this is what I was told only today by someone who has this product but is paying monthly and desperate to stop the payments.

    you may wish to join the queue to get them to cancel any future payments on your card

    I have (sorry~HAD:p) setanta through Virgin Media which is included in the XL TV package~ I wonder if they will knocked some monies off due to them not broadcasting anymore:confused: how about not a hope in HELL:rotfl:

    setanta have to cancel the CPA and i dont think you will be refunded for paying in full unless the administrator refund you as a creditor eventually, i guess:confused:

  • If you paid in one lump sum payment then you may be able to make a complaint under section 75 on the consumer credit act 1974. Basically this legislation applies to any transaction over a sum of £100 and if there is a breach of contract or misrep you are entitled to remedy. My two cents is there is a breach of contract - you have not got the service that you paid for. I would suggest you contact egg and make a complaint. If you remain unhappy you can refer your complaint to the Financial Ombudsman Service. Good luck

    Taking into account the pro-ratio of the duration of the contract he'd be less than £100 which is minimum s.75 protection level - i.e. waste of time. Claims are proportioned remember so if a company went bust and you had a warranty you can claim for this if you had a certain time left and more than £100 in value (pro-ratio)....

    i.e. buy a TV - costs £750
    buy extended 3yr warranty at £300

    pay £1050 on visa.

    TV breaks after 1 year, you ring to claim and shop is bust.

    You can then claim s.75 as you'd have a proportionate amount of £200 in a live contract so you are eligible to claim under s.75.

    I checked my payment date and its actually 30th April. Thought I had it longer than that so with a bit of luck I should be covered even if it based on pro rata loss.....

    Setanta has announced that they will no longer be collecting any subscriptions from UK members so anybody with a CPA need not worry about further charges to their cards.
  • A friend of mine has just gone to his bank and told them his debit card had been lost/stolen, with the idea that any recurring payments will not be honoured as when a new card is issued they amend the number and cancel the old one so no further payments can be taken and says he will now convert any recurring payments to direct debit. Is this actually legal to do?

    hey, you can make a partial non receipt of service claim if you have paid in advance (£80 is £80 at the end of the day) the £100 pound marker does not come into play with chargebacks and you do have the right. Give you cc provider a call likelyhood is they'll be expecting your call lol just tell them you've paid and want to claim back the remainder from todays date.

    Also I'd advise you to send a cancellation letter to Setanta just for your own protection (incase someone else buys them out and starts billing or anything like that) always better to do it. anyway address to do it is:

    Aren't Setanta in breach of contract even if some fool does buy them out? They ceased transmitting content at 6pm yesterday, so any contract must surely be breached?
