Yes if you appeal you will be paid the assessment rate of ESA until the appeal is heard.
It can increase you chances of success with the appeal if you get help from a welfare rights officer.
You cannot choose to claim the income based ESA instead of the contribution based ESA, depending on your circumstances the contribution based ESA could be topped up by the income based ESA.

PC10 has taken a year's sick leave and has a job waiting for her when she is ready. I have never heard anything so stupid. Some people will not sleep tonight worrying about finding a job.
a friend of mine,s son was diognosed with leukemia at aged 29 and his job was held over for him till he was well
he loved his job, and the fact it was still there for him kept him going through the chemo and all the pain + suffering , mentally + physically that goes with that terrible disease for over 1 yr
he,s in remission back at work , and v grateful for all the support from the company he works for
it helped him fight for his life and so far has worked

ESA - I tried for ages today to get through to the Belfast office and never got speaking to anyone! Anyway I managed to get an appt with my local advice centre tomorrow so they will help me fill in the appeal form etc hopefully.
Tomorrow the lines dont open until ten o'clock and it is one of the busier days. Friday is probably the slackest day. The advice centre will most likely have a stock of GL24's anyway.0 -
Seriously? The place is coming down with staff on the telephone teams. The waiting times have come down considerably. You are claiming and living IN Northern Ireland arent you?

personally if at all poss , get down to your local jsa , and fill out the appeal form there and then , and get a copy and recipt of it as they will only continue to pay you esa from the date of recipt of the appeal .
.. god forbid if you send it back to them via post ,seeing they dont as a matter of course send out an appeal form with your letter of stopping esa who knows if they will admit to recieving an appeal....."enter black hole .com ":rotfl:

If you are in the first 13 weeks of your claim or after 13 weeks but it has not been decided which group you are going to be in or you are appealing the ESA decision you will receive the assessment rate of ESA.0 -
ESA - yes Im in Northern Ireland - must have been a busy time when i phoned. I have my appt with advice centre later so I wont bother ringing again.
macaque - there is nothing that I would like more than to be well enough to return to work and get stuck into my new job. As my previous job was responsible for making me ill, I have been redeployed into a less stressful and better managed department. Theres not much point in me going to work there if I am not able to work accurately and quickly. Mistakes would be very costly.
Despite what you may read into my NIL points, my GP, my CPN and the occupational health consultant all deem me to be unfit to return to work at present. Maybe they know nothing!0 -
ESA-I thank you for your support! See my other replies today-all is going ok. If i did your job I too would get frustrated...but you give a lot of help on here! Myself/GF are not happy to be claiming benefits (I've not done so for at least 15 years!) BUT needs must & at last we are sticking our heads up over the financial cliff...so again thanks for all your help.0

got my appeal form completed and sent today so thats something.
I phoned the Belfast office again today and got speaking to someone this time - he was trying his best to be helpful but was obviously new and kept on having to go and check with someone else - he is sending me a form to apply for help with my mortgage; confirmed that whilst I am appealing, payments of ESA will restart at the same rate again.
He told me that I couldnt change from contribution based to income related whilst appealing. But I could make a fresh claim although he wasnt able to tell me what extra benefits there would be to me to claim IR or what other implications there might be.
The lady in the advice centre wasnt able to help me much about that either so if anyone does know whether eg I would get more money if I applied for the IR ESA ( I have no other income, no partner and grown up independent children) or what other benefits go along with the IR ESA ( I already get free prescriptions due to an ongoing medical condition and have just had a dental check up with no further treatment necessary!)
Or should I just stay on the contribution based?

I wouldnt make a new claim as that will be a new claim within six months of a disallowance and they are likely to just turn down the fresh claim. If he or she checked it out it was hopefully with one of the 'experts' in the office. In that case I would stay on ESA(C) even though it doesnt bring the other benefits along with it that ESA(IR) does.0
