claiming bank charges - and defualted account

Hi all,

I need some advice.
I just had a letter from J2 solutions ltd which when are a tracing agency I looked them up online and found alot of complaints about them calling neighbours etc.

within 2 mins of reading this letter the next door neighbour called to say she had a phone call about people asking about me and when she asked who they were they hung up.

Anyways.. I called up and it in connection to a debt of 1.5k which was with the abbey national. I had this account when I was a student I literally ended up paying £300 a month in bank charges and was sinking in debt so basicly stopped using it. This was approx 5 years ago.

I ahve worked hard to get out of debt paying over 25k off. So I am happy to face this debt and want to get it payed off. I forgot all about it really and it never appeared on my experian report, and they ahve never contacted me priviously.... I never accepted the debt untill they send over the paper work.

My question is i literally paid £300.00 a month in charges when I had this account and stopped using the account as I literally had no money becuase of the charges. Can I claim these charges back in the normal way even if this account is in default ?
if so how can I get a copy of the charges and previous statements.

    Firstly Abbey need to provide the details back to July 2001. Add the charges up and see how much it comes to. Then put in a claim, it is important to know if you have been defaulted and how much the default is against the charges you are claiming. If the amount is higher than the default then you may on the conclusion of the OFT test case have a case for the default being removed. However, it is surprising they haven't got a default already outstanding.

    And by the way, ringing your neighbour is a complete NO NO and could be a breach of OFT debt collection guidelines.

  • Hi thanks for the info, the person I spoke to said that the account is now defaulted and the amount is £1400. I think it could be quite close to that is there a different procee i need to take to get that defualt removed?

    Do you know when you were defaulted as it drops off your credit record after 6 years anyway?

    am a newie to this so just finding my way!!

    i sent a letter of financial hardship to abbey around the end of june. am i right in saying they have 40 days in order to respond to me? as of yet ive had nothing.

    any advice/help very much appreciated.

    No they don;t have 40 days to respond to you,
    Where did you send it and was it sent recorded delivery?

  • 24th june and i have a feeling that it wasnt sent recorded, was in a hurry that day!!!! is this bad? is it worth calling abbey anyway?

    also, i have a capital one cca, not sure what to do next? not heard a peep out of capital one nor the DCA in question, any advice on this too please. should i send out a letter of some sort, carry on paying token payments and ignore DCA or......
