This might explain how this happened, taken from HMCS web site.
Once you have submitted your request for judgment by default, MCOL will deal with your request. Where it is received before 9am on a day when the court is open, the request will be processed at the end of the day: where it is received after 9am, it will be processed on the next day (again, at the end of the day) when the court is open and may not appear on MCOL until the following day (see viewing the progress of a claim).
This means that, if the defendant files a response (an acknowledgment of service, a defence or a part admission) with the court by 4pm on the same day as your request is to be processed, the response will take priority over your judgment request.

I got the defence docummentation from Bond Pearce today.
Shame Judgement by Default has already been issued. I have to say though there defence doesn't hold much water from what I can see.
They also seem keen to ask the courts to put to the test if the items were bought as a consumer or in a business capacity. I can not see why this matters as the contract is the same isn't it? Do B&Q not supply the trade??? Do I have more than one downpipe on my house??? If I had purchased in a business capacity surely I would have used my business account to buy the purchases, so I could recoup vat??
It has made me very annoyed - do B&Q wish to keep me as a customer?0 -
Just going through this again, it is unbelievable.
Apparently B&Q were aware of an error with the rain harvesting tanks on the 21st June and took immediate action!!! I actually believe mine were purchased before the time of the first post on this website and didn't customers purchase these a day or two later? And then there is this website - apparently "individuals engaged in these forums have automatic alerts set up and monitor the Forums to ascertain when retailers experience problems...... ..... with the intention of taking advantage of such problems". - Sounds very clever how is this done??
It then goes on to mention, as an example "Zanussi Integrated dishwasher - £94 delivered @ B&Q Possible misprice".
Surely that title is suggesting a bargain as the poster has absolutely no certainty if this is a misprice or bargain. Turns out this was a bargain. Why bother having an advertising budget to attract customers? Shame they didn't have enough stocks to fulfill their orders. Was this caused by:
1 Act of God
2 War and other hostilities
3 Civil commotion
4 Accident
5 Strikes
6 Lock outs
7 Trade disputes
8 Acts or restraints of Government
9 Imposition or restrictions of imports or exports
or any other cause not within the reasonable control of B&Q
Who is to blame for poor stock control or computer systems if it isn't B&Q?
Come on B&Q - don't alienate your customers, supply them with the goods or equivalent which you formed the contract with. You made the rules, we played by your terms and conditions. Contract is formed upon payment as per your wording. It is that simple, where is your arguement?0 -
