    Summary of key arguments
    1) June 09 Beckett V B&Q dishwasher case
    2) Terms and Conditions at the time states a contract was formed
    3) T&Cs have no mention of pricing error, stock error etc
    4) Discretion argument - there is none
    5) There was no visible T&Cs on the website
    6) You were not asked to (and still not asked to) accept T&Cs
    7) B&Q now amended T&Cs (sign of weakness?)
    8) B&Q reprudiated the contract, giving us the right to sue

    Evidence to be clarified
    1) TS to confirm whether 'discretion' is Unfair Term in Contracts
    2) TS to confirm whether B&Q can rely on Terms when customer does not accept them or have to see them
    3) TS to confirm whether B&Q were in breach by stating the argonaut order could not be accpeted when a contract was formed, the order was accepted and money taken
    4) TS hopefully to ask B&Q to renotify customers that there was a contract and the order was accepted.

    So don't anyone tell me we havent all worked hard. The thread has been brilliant and knowledge shared makes a stronger case. Hopefully TS replies will strengthen the extra arguments we have to make.

    As I said, I am pushing for B&Q to rewrite to everyone to inform them they were wrong.

    I've learned loads and loads, well worth the experience - win or lose.
    It would be nice for B&Q to put their hands up and admit they were wrong, it would have been nice even for B&Q to have offered a token gesture of goodwill of say a £10 voucher, but no, and it's far too late for that now. A letter from them saying sorry - I don't think so.
    Hopefully B&Q will have learned something as well, if they haven't it's an opportunity lost - but maybe that's just B&Q - management I'm talking about, as to be totally honest I've had excellent service from their instore staff, even just this last week, a credit to them. Probably working for a pittance as well.
    The balls in B&Q's court now, if they don't sort it, they will end up in court AGAIN.

    My claim is in and there is nothing I can do for myself as no doubt it will be a long drag before court date is given.

    and I have several emails from that person verifying otherwise. Lynsey has cc me in on emails asking for the water butts to be sourced by B&Q elsewhere - again you don't know the full facts and you are spouting sh ite again.
