    If they are then they can't be sold on ebay anyway so the point is irrelevant. I still think these are some sort of collectables.

    The wholesaler of the tin toys will only sell to retailers once they have agreed to their terms around these type of "toys".


    Current Toy Safety legislation says that anything 'designed or intended' as a child's plaything must conform to certain standards. These items do not conform, so one must not sell them unless one can establish that there is no possibility of their being thought to be playthings. And even then, having ignored the implications of 'designed', one may not have satisified the requirements of the law, although it may be fell that the spirit at least has been observed.
    For the past fifteen years xxxxxxxx. have sold toys of this sort by mail order, making it clear on order forms, in catalogues and by labelling, that they were being offered only to adult collectors for their own use. Throughout, Trading Standards, locally and nationally, have been aware of exactly what was being done and what precautions were being taken.
    As importers and distributors with connections to almost every tin toy maker in the world, xxxxxxx is able to supply retailers who wish to offer such items to the public. However we will do so only where we have been convinced by assurances that the required conditions will be met.
    If subsequently they are met, then we as distributors will invite Trading Standards to deal with us over any worries they may have; and conversely if the retailer does not adhere to the conditions we will try to accept no reponsibility. We will look at each application individually when deciding whether we can legally supply a retailer

    My bet was going to be toy steam or possibly old toys produced in or covered in paint containing lead.

    I wonder if the OP will return to clarify?

    Perhaps the OP should enclose plenty of this with the items he sells? :D

    Most of the toys I sell are from the 1980's and may not comply with today's toy safety regulations. The item in question is two large transformers toy trucks. They were made in the late 1990's but still may not be covered by today's regulations.

    Oh well we were both wrong on the item in question.

    The thing with regulations are that they very rarely are retrospective.

    If you look at big boys toys (e.g. cars), ones produced last century may not meet current regulations, but that doesn't stop people re-selling or using the vehicles on the road.

    I personally wouldn't send it, because i'd be worried about the child getting hurt. But thats just my opinion :wink:

    I don't understand why you can't allow a child to have something given to him by his father? Does it have very sharp pieces or is dangerous if used as a toy?? Would it be deemed as 'adult' in a sexual way ?

    Surely it is up to the buyer to do whatever they want with the item once they have it and thus take the consequences if they child injures themself rather than it being your fault?

    responsibility is with the parent...

    as a seller I can't see why you would dictate who can or can't play/buy these things...

    how do you know who/where your past sales ended up?

    Its a bit OTT and like others said who knows where you past items have gone too?

    Thing is this boy is NINE! and he is going to be playing with some transformer trucks that at the time of being sold there were millions of nine year olds or even younger playing with that toy or from that range.

    When i was nine i knew not to shove things in my mouth and what not.

    Don't turn down a sale. Let the child enjoy the toy!

    Your thread title says it all: "Adult buying for a child on Ebay?"

    It's the adult buying it. What's the problem? They could beat an old lady over the head with it, but that wouldn't be your fault. :rolleyes:
    If you lend someone a tenner and never see them again, it was probably worth it.

    Every credit to the OP though - trying to take responsibility for a childs safety, when it's clear that there are a lot of parents who don't bother.

    If the toy has been deemed unsafe or unsuitable since it was first made, then I think the OP is doing the right thing.

    How many people here would give their child a toy today that had toxic paints, unsafe or small parts - but it was deemed fine 15-20 years ago? We live in a society where compensation culture, and lack of self-responsibility is rife. The OP is right to try to cancel the sale. No doubt if/when the 9 year old boy chokes on a part, or badly cuts themself, then the irresponsible parent who insisted on making the purchase will be looking for someone else to blame.
