Orange Account fraud help

I hope you can help!

Back in December, I was contacted by Bryan Carter Solicitors (Weybridge, Surrey) informing me that they are taking me to court regarding an Orange Mobile Phone account.

It was the first I had heard of the matter and requested from them further details, a statement of account, a copy of the credit agreement or contract and a few itemised bills to aid me in deciding whether the charges were mine and the account actually belonged to me.

I don't ever remember having a contract with Orange and my first thoughts were that it is a fraud case.

Unfortunately, Bryan Carter Solicitors are unable to provide anything but a copy of an account statement, and obviously this is not helpful in deciding whether the account is mine.

So I contacted Orange and asked them to provide the evidence. After sending a letter via recorded post and making several telephone enquiries I was told that the copy invoices and credit agreement is not available. I was advised that I could complete a fraud questionnaire, and the telephone advisor asked me several questions. They have not contacted me since, I believe this was around the end of December or start of January.

I called them again in March asking for the same information, and was told that they would pop it into the post for me, and again I have heard nothing. I called them a few minutes ago and was told it was not available.

Obviously this is going to go around in circles until Bryan Carter Solicitors file for a CCJ against me, but all I want is the relevant information to convince me that this is my account.

I would like to know where I would stand in court if Bryan Carter Solicitors or Orange cannot provide the information? Would it be worth just paying it off even though I believe this fraud? (The account balance is £564.93)

If you want any further information, or can provide some advice, it would be greatly appreciated.

    On the account statement does is show either the mobile number or the account number ? And the address on the statement yours?

    It does show the relevant details, and the address on the statement is my previous address
    All I have been asking Orange to do is forward some details to convince me the account is mine and that it is not fraud... Hopefully Jonathan will be able to resolve!

    I guess someone could have used your previous address after you'd moved.
    I work in the fraud dept at Orange, but Jonathan will pass your info on if he needs to.
