I was tempted to send round the very large dog we bought to run in to her garden through the broken fence with a note tied around itc neck saying congratulations you just bought yourself a broken fence, ps the deeds say that you need to keep the fence in a good state of repair and I dont know if youve noticed but it it needs a little work
although I think your idea is more subtle, I like it, naughty but nice

you're both trying to get out of it. you actually deserve each other if you do that.
just go half each. The border is clearly defined. The fence benefits both parties.
just tell them that you're prepared to go half each.
If they decline, then just pay for it yourself, they'll lose in the long term if they go through their lives with that attitude.

I might have offered to go halfs with her on this untill she flatly refused to believe that the fence was hers and said that it was mine, to be fair I wouldnt expect my other neighbours to pay for my fence when/if it blows down would you?0 -

and if I pay for it this time and it blows down next year, then the year after and the year after, do I keep paying to have it fixed, ata few hundred pounds a time?

First sollution if you put a new fence 2 " inside your boundry its yours push HER fence onto here propberty and make your own fence.
Alternatively inform her its hers as you say by the deeds and suggest as it blows down regularly that she may want to concrete it in and allow enough of a gap between the boards to let the wind through to save her doing it again next year.If it doesnt pay rent sell it.

We have been on quite good terms with the neighbours since moving in and would have been prepared to go 50/50 on the fence untill she kept insiting that it was our full responsibility, anyway she has said that she is going to check with her solicitor about the fence so I am going to leave her to it (she wouldnt accept our solicitors letter from when we moved in) so i presume she wont accept our copy of the deeds, better let her find out for herself as she may then accept we are right if she has to pay to find out and her solicitor confirms that its her fence0
