I would ring the company up. The email address could have been faked.

I agree with jenniferpa, get yourself a lawyer and only deal with this company in writing, don't say anything at all before you get advice.

Hewitsons is Nikes representative in the UK.

The letter is sent as an attachment to your email address because eBay are not allowed under the Data Protection Act 1998 to release your address or telephone details without a court order. They can release your email address though (you agreed to this in the user agreement) and so the letter is sent in electronic format.

From this page on eBay (link listed on the VERO - Verfied Rights Owner page):
    http://cgi3.ebay.co.uk/ws/eBayISAPI.dll?ViewUserPage&userid=nikeuk

"It is therefore illegal to import unapproved Nike product into EEA countries from countries such as China, Taiwan, Philippines, Hong Kong, USA etc. It does not matter whether the goods being imported are new or second-hand. "

    Nike UK’s contact e-mail address is - nikeebay@hewitsons.com

Contact this email address for confirmation. Remember that they do not have your address or telephone details unless you give them away or they start court action against you.

    Hope this helps.

They could be a scammer who has bought from you before and has your details that way! Is there a reference number on the letter? call up the company fromt he website number and quote reference number just to see if it is genuine then perhaps you can tell?

But the OP states in his post they have his full name and address so if ebay didn't release then who did?

I would ring and just ask to speak to the person named on the letter as a sender/contact. I wouldn't use the phone number on the letter unless it matches the number from company website. If the person doesn't exist it's probably fake unless they've done proper research.

Ok you say you sell them and its legal and above board then you wont have a problem, as such, an easy defence would be that you purchase these items and upon paying for the item they then become yours to do what you wish with them, after all you enter into no form of contract when you purchase an item from a Nike store etc that you will not sell the goods on.

However I shouldnt imagine Nike would act without some form of evidence against you therefore maybe you should start asking questions of the people who are selling you the items.

    All the best

Where do you get the trainers from?

You don't say you import them, you say the email suggests you import them, so do you import them or get them from somewhere else?

They cant stop you selling trainers you brought yourself here ( not imported) unless they have evidence to the contrary which is what it seems from what they are saying. I suprised they have your details, they would normally have gone via ebay. They must have recieved a complaint from one of your buyers who provided your details to them.

I would ask them to clarify everything and how they have came to the assumption you are importing the trainers but dont verify any of your details with them. One they provide you with further details you will have a better understanding of what to do next.

As I understand the system (and I confess I don't know much about e-bay) all they would have needed to have done would be to buy a pair themselves to get the full details of the seller. This also would have given them a pair to establish the exact product on sale.

Yes they can, you do not buy resell rights when you buy an item in the UK. Whilst in practice this is nonsense, how would we all find items to sell otherwise, in reality some manufcaturers of branded goods have purges to stop their items being sold by third parties.

It usually applies to luxury items like high cost cosmetics and such like, although in the past year Disney and one of the other DVD film companies got ebay to start pulling DVDs.
